Jared Dains <br />South Platte Combined Replacement Plan <br />March 14, 2012 <br />Page 7 <br />the 13.5 Whitney Ditch shares has been estimated from a dry-up farm headgate delivery of 24.75 <br />acre -feet per share (which include the 15% ditch loss) or approximately 334 acre -feet for the 13.5 <br />Whitney Ditch shares. After accounting for the return flow obligations the total consumptive use <br />credit for 2012 is projected to be approximately 190.03 acre -feet. <br />During the 2011 irrigation season Aggregate utilized the return structure owned by the Whitney <br />Irrigation Company located in the SE1 /4 of Section 30, Township 6 North, Range 66 West. <br />Aggregate anticipates that this return structure will be utilized again in 2012. A copy of the <br />agreement with Whitney Irrigation Company needs to be submitted to the State Engineer's Office if <br />the return structure will be utilized in 2012. <br />The dry -up locations for these shares were originally identified through an April 12, 2011 letter to <br />the Division 1 Engineer. That letter stated the northern portion of Orr Farm #1 may continue to be <br />irrigated using 1 of the 13.5 Whitney Ditch shares owned by the Applicant. In 2011 the entire Orr <br />Ditch Farm #1 was removed from irrigation due to damage to the lateral serving the property. <br />Therefore the entire farm is now included as a dry-up location for all 13.5 shares dedicated to the <br />plan in 2012. A revised share dedication dated February 29, 2012 is attached. The revised 2012 <br />dry -up maps are to be provided by April 1, 2012 in accordance with our dry up protocol. <br />Boyd & Freeman Ditch <br />The 240 Boyd and Freeman Ditch shares were historically used to irrigate 85 acres of pasture <br />grass. Using a Blaney - Criddle analysis the potential crop consumptive use for the 85 acres was <br />determined to be 142 acre -feet. Assuming a 10% ditch Toss and 55% farm efficiency the dry year <br />consumptive use was determined to be 99.28 acre -feet. The applicant will utilize all 240 shares in <br />this plan. <br />The Boyd and Freeman Ditch shares were sold to the City of Greeley ( "Greeley ") in 2011. Greeley, <br />in a letter dated September 12, 2011 confirmed that Aggregate may continue to utilize these shares <br />for this plan. Before any credit can be taken for the Boyd & Freeman Ditch, accurate measuring <br />and recording devices must be installed and those devices must be approved by George Varra, the <br />District 3 Water Commissioner. The City of Greeley is currently designing an augmentation station <br />for the Boyd and Freeman shares and anticipated that construction will be complete before the <br />2012 irrigation season. If the Boyd & Freeman augmentation station will not be installed, Aggregate <br />will request more water from the City of Greeley or the Platte River Power Authority and the Boyd <br />and Freeman shares will not be used for replacement purposes during this plan period. <br />The expected consumptive use credit for the 240 shares of the Boyd and Freeman has been <br />estimated from a dry -up farm headgate delivery of 0.77 acre -feet per share (which include the 10% <br />ditch loss) or approximately 184 acre -feet for all 240 shares. After accounting for the return flow <br />obligations the total consumptive use credit for 2012 is projected to be approximately 142 acre -feet. <br />This value is greater that the estimated dry-year yield because no deliveries were made in 2011, <br />thus Aggregate does not owe any subsurface return flows for 2012. <br />City of Greeley Lease <br />The Applicant has leased 22 acre -feet of fully consumable replacement water from the City of <br />Greeley ( "Greeley "). As mentioned above, if the Boyd & Freeman augmentation station will not be <br />installed Aggregate will request more water from Greeley. Additionally, pursuant to the mining lease <br />Agreement between Aggregate and Greeley for the East 8 Street Pit, Greeley will provide <br />augmentation water for this pit. In 2012 the replacement obligation for this pit totals 29 acre -feet <br />and you are requesting to make block releases in April and October 2011. A copy of the Greeley <br />leases were provided to this office with the SWSP request and are attached to this letter. <br />
