Compliance With Mine Plan N - Support Facilities Not On -site <br />R - Other N - Special Categories Of Mining <br />N - Processing Waste R - Topsoil <br />COMMENTS <br />This was a complete inspection of the Terror Creek Loadout by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. No representative was present during the inspection (although there were two <br />members of the office staff present during the records check). The site is a loadout only. The loadout was <br />receiving coal at the time of the inspection. There was no active coal processing taking place during the inspection <br />but all three of the coal stockpiles contained processed coal. There were several train cars at the loadout facility <br />but the operator was not actively loading the cars at the time of the inspection. The weather was warm and sunny <br />and the ground was damp and muddy in spots. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />- The records were located in the main office at the Terror Creek Loadout. They were in two three -ring binders <br />and a filing cabinet. All of the necessary records were available for review. Please see the Availability of Records <br />checklist at the end of this inspection report for more details. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, <br />4.05.9; Stream Buffer Zones 4.05.18: <br />- The sediment pond contained a small pool of water and was not discharging at the time of the inspection. The <br />embankment was well vegetated and stable and no erosional problems were noted. The emergency spillway was <br />stable and well maintained. <br />- The small dugout pond by the railroad tracks contained a small amount of water and was not discharging at the <br />time of the inspection. The pond was stable at the time of the inspection. <br />- All of the ditches around the site were clean at the time of the inspection. The sediment control ditch, leading <br />into the sediment pond, did contain some standing water but no problems were noted. No erosional problems or <br />down - cutting was noted in any of the ditches. <br />- All of the culverts under the haul road and the light -use road at the east side of the site were clear at the time of <br />the inspection. <br />Number of Partial Inspection this Fiscal Year: 6 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 2 of 5 <br />
