RPM, Inc. <br />removal and disposal of the liners in both of the ponds, as well as backfilling, topsoil <br />replacement and seeding costs. Please provide the Division with the approximate volume of <br />material required to backfill the ponds and indicate where the material will come from. <br />In adequacy response dated January 6, 2012, we state in part, <br />"THE CROSS MINE PORTAL WILL BE ALLOWED TO CONTINUE TO DRAIN AT A RATE EQUAL TO OR <br />SIMILAR TO ITS PRESENT CONDITION ONCE MINING AND WORKINGS DEWATERING IS STOPPED. <br />DRAINAGE FROM THE CROSS MINE DECLINE PORTAL MAY ALSO OCCUR ONCE MINING OPERATIONS <br />CEASE AND THE MINE WORKING ARE ALLOWED TO FLOOD. DRAINAGE FROM THE CROSS DECLINE <br />PORTAL, IF IT OCCURS, AND THE EXISTING CROSS PORTAL DISCHARGE WILL BE ROUTED THROUGH <br />DITCHES TO POND #2. POND #1 IS PROPOSED TO BE REMOVED AS PART OF THE RECLAMATION PLAN. <br />POND #2 WILL REMAIN. GIVEN THE NATURE OF THE HOST ROCK, NO SIGNIFICANT CHANGE IN <br />HISTORIC WATER QUALITY IS EXPECTED. THE PROPOSED CLOSURES ARE NOT INTENDED TO <br />PROHIBIT MINE DRAINAGE, RATHER TO SECURE THE PORTALS FOR PUBLIC SAFETY. THEREFORE, THE <br />PROPOSED ENTRANCE CLOSURES SHOULD BE ADEQUATE." <br />As stated above, the proposed plugs are not intended to be hydraulic seals. The hydraulic seals <br />are not part of this Amendment. The adit/portal closures under this Amendment are intended to <br />secure the openings and allow for mine drainage. It is assumed that if backfilling of pond one is <br />required prior to approval of this Amendment, or development of the waste rock stockpile, the <br />fill material would have to be hauled in from off -site. (The waste rock stockpile is intended to be <br />the source of fill for pond one.) <br />Pond two is proposed to receive discharge from the draining adits and should not be eliminated. <br />We have included the dimensions as requested for informational purposes. <br />• Pond #1 55ft. X 50ft. X 3 ft. deep. <br />• Pond #2 74ft. X 91ft. X 5ft. deep. <br />4. The Applicant has submitted a letter from the landowner requesting that a number of <br />structures remain after mining and reclamation are complete. The Division approved Technical <br />Revision No.4 on June 21, 1999, which allowed structures which had the proper permits or were <br />constructed prior to the issuance of permits to remain on the property once mining and <br />reclamation are complete. It is the Permittee's responsibility to demonstrate to the Division that <br />the structures which have been requested to remain onsite are compatible with local zoning <br />ordinances. The Applicant may submit documentation from the Boulder County Land Use <br />Department which demonstrates the structures may remain onsite.
