Janet Bums of DRMS reviewed the photos. The weather was clear and dry at the time of the <br />aerial flight. Thin patches of snow are visible on undisturbed north facing slopes. <br />The mine is a reclaimed surface mine. No buildings or mine personnel remain on site. There are 5 active gas <br />wells not owned by New Elk Coal Company adjacent to the Lorencito Canyon Mine reclaimed area. The gas <br />company utilizes the Jeff Canyon Haul road to access these wells. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />There are 3 excess spoil fills on the mine site. These fills are reclaimed and appear stable. <br />Fill 7 appears to have some rill formation on the west side of the 2nd bench. These features need to be monitored <br />by the operator. <br />Fill 8 appears stable and well vegetated. A gully appears to be forming immediately northeast of the 1st 6118 <br />bench. This feature needs to be monitored by the operator and mitigated if the feature is impeding the <br />reclamation. <br />No concerns were identified from the aerial photos of Fill 9. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053 ; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Impoundments 4.05.6, 4.05.9; <br />All the visible sediment ponds were dry at the time of the inspection.
