VII. PROJECT DECISION: <br />The Planning Division hereby aggroves the Fruita Loadout Major Site Plan subject to the <br />following conditions: <br />I. Review agency comments from the following agencies that are not in conflict with the <br />conditions of approval shall be addressed: <br />a. Mesa County Floodplain Administrator <br />b. Development Engineering <br />c. Transportation Planning <br />d. Mesa County Health Department, Air Quality <br />e. Environmental Health <br />f. Mesa County Building Department <br />g. City of Fruita <br />h. Lower Valley Fire Protection District <br />i. Grand Valley Power <br />j. Colorado Department of Transportation <br />2. For the duration of the operation the applicant shall continually comply with all <br />applicable provisions of the Land Development Code. <br />3. Payment of a Transportation Impact Fee in the amount of $23,982.48 is required at the <br />time of final Commercial Site Plan approval. J <br />4. The applicant shall provide updated copies of any plans, reports, or documents that are <br />revised in response to comments from review agencies or other permitting authorities so <br />that the most current copies are included in the project file. <br />5. The applicant or operator will obtain and maintain all required local, state and federal <br />permits for the operation of the project. Copies are to be submitted to the Planning <br />Division, including but not limited to copies of the following: <br />a. Permit from the Colorado Division of Reclamation, Mining, and Safety <br />b. Air Pollution Emission Notice (APEN) from the Air Pollution Control Division of <br />CDPHE <br />c. Applicable Stormwater Discharge Permits. <br />d. Letter of Map Revision from FEMA <br />e. State Highway Access Permit from CDOT <br />L Applicable permits from Colorado Department of Health- Water Quality Control <br />Division <br />The basis for this decision: <br />The petition complies with or has the ability to comply with the criteria in Section 3.5.11.2, <br />Chapter 5, Chapter 6, and Chapter 7, of the Mesa County Land Development Code (2000, as <br />amended). <br />6 <br />
