d. Map 4 — Depicts the total acreage seeded, the total acreage mulched and the total
acreage fertilized.
e. Map 5 — Depicts the weed species treated, the control area, and the control type.
f. Map 6 — Depicts more clearly the acreage that has been reclaimed in 2011.
14. Yes. Weed control was conducted in accordance with the Weed Control Plan submitted in
Amendment AM -06 in August 2010 and the weed species and control type are found on
Map 5 in Appendix 2. The control type, application rate and treatment dates are found in the
tables following the maps in Appendix 2.
15. Yes. As described in Amendment AM -06, adequate topsoil for reclamation has been
identified /reserved within the affected land boundary. However, not all available cover
material has been stripped and stockpiled. Climax has been segregating and stockpiling
topsoil since 1979 based on areas of disturbance associated with mining activities.
Although current soil stockpiles do not currently meet final reclamation needs, topsoil from
future disturbed areas will continue to be stockpiled, and Climax will utilize its award - winning
biosolids composting method to generate additional nutrient -rich topsoil replacement. Many
acres have already been reclaimed utilizing this method with great success.
16. Yes. Stockpiled topsoil has been vegetated and stabilized.
17. NA. Mining activities have not exposed groundwater.
18. Yes. All hazardous materials at Climax are stored within approved spill containment
structures.
19. Yes. The financial warranty approved with AM -06 is sufficient to cover the cost to complete
reclamation.
20. Yes. Climax's basis for legal right to enter (as described in AM -06) is still valid.
21. Yes. Annual monitoring information is in Appendix 3. Please note that the Water Quality
Monitoring Plan was approved by DRMS as Technical Revision TR -18 in late December
2011. Therefore, Climax was not able to collect all data required by this plan in 2011 due to
time and access constraints. Climax expects to fully implement the new monitoring plan in
2012.
