February 23, 2012 C- 1981- 012/New Elk Mine JHB <br />2/24/2012, pending no comments or concerns from other agencies or concerned parties. <br />PROCESSING WASTE /COAL MINE WASTE PILES — Rule 4.10 and 4.11 Drainage Control; Surface <br />Stabilization; Placement: <br />RDA: No new material has been placed on the RDA since the Division's January 11, 2012 inspection. The <br />operator continues to grade and compact the refuse material already placed on the RDA. The operator will be <br />placing new material towards the south of the pile to bring the elevation of the surface level and inmprove the <br />drainage of the pile. The operator is storing rock and cover material at the NW portion of the pile. Bobby <br />proposed using some of this rock material to dross the in refuse drainage swale at the NE portion of the RDA to <br />permit equipment to cross the swale for access to the Cell tower installation location. The operator would remove <br />this rock from the swale once the work is completed. This activity will not dam water on the pile and will allow <br />any runoff to drain along the swale, while allowing equipment to cross the swale. This is acceptable and remains <br />within the RDA perimeter. <br />Culverts in the RDA have been replaced and are clean of sediment on waste material. Ditches at the RDA remain <br />established and not blocked by equipment or material. <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />Mine roads are maintained in good condition throughout the mine site. Snow removal from the haul road was <br />being conducted during the inspection. Bobby inquired how the slurry line was permitted to cross the access and <br />haul roads. The permit states that the slurry line will be buried under road crossings. Once again, a copy of the <br />permit at the mine site is necessary for surface foreman referral. <br />SIGNS AND MARKERS — Rule 4.02: <br />The mine Identification signs at the entrance to the mine site from Colorado State Highway 12 and the entrance to <br />the Jansen load out contain the appropriate information. <br />Disturbance area boundary markers are delineated at the load out by while roof bolts. The disturbance area <br />boundary is appropriately marked at the load out. <br />White roof bolts are also used for Disturbance boundary markers at the mine area and RDA. Bobby Steele thought <br />the disturbance area boundary at the north side of the RDA matched the property boundary. This is not in <br />agreement with Map 11. NECC needs to assure that the disturbance boundary markers accurately reflect the <br />approved disturbance area boundary. Copies of maps showing the approved disturbed areas need to be available at <br />the mine site. The operator needs to correct the placement of the approved disturbance boundary <br />markers. <br />OFFSITE SUPPORT FACILIITES - Rule 4.04,4.28: <br />The Jansen Load out was inspected. A BNSF engine was on the track. NECC representative, Bobby <br />Steele spoke with the train crew. The BNSF crew was picking up the 18 rail cars stored on the Load out track to <br />remove, in anticipation of a unit train. <br />Number of Partial Inspection this Fiscal Year: 8 <br />Number of Complete Inspections this Fiscal Year: 2 <br />Page 4 of 8 <br />
