The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the City
of Greeley amendment application for the 25 Avenue Site, File No. M- 2002 -020, and submits
the following comments. Preliminary review of the information received determined the
following items must be received before the Division can consider the application as being
submitted and technical review can begin:
Application Form:
1. The permitted acreage listed in Item #3 of the application form (87.05) differs from the
approved permitted acreage for the site (89.16). The Minerals Rules and Regulations of the
Colorado Mined Land Reclamation Board for the Extraction of Construction Materials does
not allow for the reduction of permitted acres through the permit amendment process.
Please revise Item #3 to list the approved acreage for the site of 89.16 acres.
As discussed in Exhibit D of the amendment application, the 25 Avenue Site permit is
permitted for 89.16 acres, including nearly one mile of 35 Avenue 30 -foot right -of -way
(ROW). The Applicant states along with the amendment application a release of performance
and financial warranties has been submitted to remove the ROW from the permit area,
reducing the 25 Avenue Site permit acreage to 87.05 acres.
The release of performance and financial warranties for the ROW area has not been received
by the Division. The Operator may submit this acreage reduction as a technical revision to the
amendment application in accordance with Rules 1.8.1 and 1.8.4. Please provide the
information required by Rule 4.17.1 for the release request, a detailed map and a legal
description for the proposed acreage reduction in the technical revision submittal.
2. The permitted acreage listed in Item #3.1 for the Greeley West permit on the application form
(197.51) differs from the approved permitted acreage for the Greeley West site (203.13);
permit number M- 1977 -081. Please confirm this is intentional and indicate on Exhibit C -1,
