Mark McLean Page 2 <br />February 16, 2012 <br />Glover Analysis data provided in the cover letter of the submittal include the following: <br />Your stream depletion analysis is also attached (see attached Table 3 (Revised)) providing a <br />monthly distribution of the steam depletion. You have calculated total stream depletions to be 31.17 <br />acre -feet for the April 1, 2011 through March 31, 2012 -plan year. Post -2011 plan year depletions are <br />projected to be 8.81 acre -feet. <br />REPLACEMENT <br />• A distance to the river of 2,400 feet <br />• A distance of impermeable boundary of 5,000 ft (approximate distance to the <br />Excelsior Ditch) <br />• Transmissivity of 100,000 gpd /ft <br />• Storage coefficient of 0.2 <br />During April 2011 through March 2012, leased fully consumable replacement credits from the <br />Arkansas Groundwater Users Association (AGUA), available pursuant to a 2 -year lease, will be <br />provided to cover mining depletions. The credits will be generated through the delivery of fully <br />consumable water available to AGUA from the Board of Water Works of Pueblo, from the City of <br />Aurora, or from the Pueblo West Metropolitan District, to AGUA's Excelsior Recharge Ponds located <br />immediately west of Chico Creek. The lease provides that AGUA will deliver up to 40 acre -feet to the <br />Arkansas River by means of recharge ponds on the Excelsior Ditch. Attached Table 4 (Revised) <br />shows the proposed accounting forms and Attachment A shows the monthly replacement schedule <br />for the 2011 plan year. <br />POST PLAN DEPLETIONS <br />Projected post plan depletions are shown at the bottom of attached Table 5 (Revised). <br />Projected post -2011 plan year depletions are 8.81 acre -feet. The replacement water lease <br />agreement with AGUA provides a means to supply replacement water for 2011 post plan depletions, <br />as shown in Attachment A. <br />The State and Division Engineers have reviewed the plan and the adequacy of each source <br />of water provided for use as augmentation water, including, where necessary, the historical <br />consumptive use of each water right, and return flows from diversion of waters imported into the <br />Arkansas River Basin or other fully consumable waters proposed for use as augmentation water. <br />CONDITIONS OF APPROVAL <br />This substitute water supply plan is hereby approved pursuant to Section 37 -90- 137(11), <br />C.R.S., subject to the following conditions: <br />1. This current plan shall be valid through March 31, 2012, unless otherwise revoked or modified. <br />2. Active mining of the site shall not exceed 50 acres unless an amendment to this plan has been <br />approved. <br />3. The mined cell must be maintained in a de- watered state to the extent that the exposed water <br />surface area does not exceed a total of 5.5 acres including all ponds, collection areas, <br />dewatering trenches, and return trenches. <br />
