EXHIBIT D <br />Mining Plan <br />The proposed amendment area for the Mined Land Reclamation Board (MLRB) 25 Avenue <br />Site is currently included in MLRB Permit M- 1977 -081, Greeley West Pit. This application <br />removes the proposed amendment area from the existing Greeley West Pit Permit and adds it to <br />the 25 Avenue Site Permit. The remainder of the Greeley West Pit Site is unaffected by the <br />proposed amendment. Upon approval of the 25 Avenue Site amendment, the amendment area <br />will be released from the Greeley West Pit Permit. <br />Introduction and Overview <br />The current 25 Avenue Site permit is owned by the City of Greeley, contains a below -grade <br />water reservoir, and is permitted for a final land use of developed water resources. Most of the <br />infrastructure has been installed for the reservoir and the site is an active water storage facility. <br />Additionally, the 25 Avenue Site is open to limited public access for fishing and non -water <br />contact recreation. A concrete, publically accessed recreational trail (the Poudre Trail) also runs <br />across the north side of the site adjacent to the south bank of the Cache la Poudre River (see <br />Exhibit C -1). The 25 Avenue Site Permit was permitted for 89.16 acres, including nearly one <br />mile of the 35 Avenue 30 -foot right -of -way (ROW). Along with this amendment application, a <br />release of performance and financial warranties has been submitted to remove the ROW from the <br />permit area, reducing the 25 Avenue Site Permit acreage to 87.05 acres. <br />The Greeley West Pit site is currently owned by Cottonwood Land and Farms, LLC and Double <br />SM Farms and consists of previously mined areas and additional areas disturbed by mining. The <br />site contains four excavated mine pits that have been partially reclaimed into four groundwater <br />ponds surrounded by upland areas of backfill and graded material (see Exhibit C -1). Two <br />adjoining ponds are located in the southwest corner of the amendment area, another is located in <br />the southeast corner, and one is found in the northeast corner (see Exhibit C -1). It is believed <br />that the ponds are approximately 20 feet deep. The two SW ponds have a combined surface area <br />of about 32.5 acres and the SE and NE ponds have surface acreages of approximately 29.5 and <br />13.5, respectively. The Poudre Trail runs through the northeast portion of the amendment area <br />adjacent to the south bank of the Poudre River and just north of the NE Pond. To contain public <br />access, the Poudre Trail and current 25 Avenue Site are separated from the Greeley West Pit <br />area by a 10 -foot chain link fence. <br />Permit Boundary Definition <br />The 25 Avenue Site is bounded by the Poudre River to the north, the Greeley West Pit to the <br />east and south, and 35 Avenue to the west. Upon approval of the proposed amendment area, <br />the majority of the site will remain south of the Cache la Poudre River (see Exhibit C -1). The <br />east and west boundaries will be bound by 25 Avenue and 35 Avenue, respectively. At the <br />southern permit boundary, most of the permit area will not extend to F Street. Although a <br />portion of the permit area will border F Street, for most of the southern boundary the Colorado <br />and Southern Railroad and Pulliam Subdivision will be between the proposed permit boundary <br />Greeley 25 Avenue Site <br />DRMS 112 Permit Amendment Application Page 4 <br />
