Mr. Chartier <br />Page 12 <br />February 16, 2012 <br />6.3.5 Exhibit E — Maps <br />4. The Mining and Reclamation Plan Maps did not contain a labeled permit boundary. As <br />required by Rule 6.3.5(2)(a), the permit boundary must be labeled. Please revise both of the <br />maps accordingly. <br />5. The Mining and Reclamation Plan Maps depict a berm around the perimeter of the pit. The <br />berm appears to be located outside of the permit boundary. The Division considers the berm <br />to be affected area and as such it must be included within the permit boundary. The maps <br />must be revised to show that the berm is located within the permit boundary for the amended <br />area. <br />6. In the letter dated December 12, 2011, the Division asked the Applicant to show the areas of <br />exposed groundwater on the Mining and Reclamation Plan Maps. The Applicant did not <br />include this information in the response received on February 2, 2012. Please revise the maps <br />to show where the 8.5 acres of exposed groundwater will occur within the 9.9 acre permit <br />area. <br />7. The Mining and Reclamation Plan Maps show that the original permit area is 8.4 acres. As <br />the Division noted in the letter dated September 20, 2011, the Chartier Pit is permitted for 8.5 <br />acres. Therefore, the amended area may not exceed 1.4 acres. The amended area is currently <br />depicted as 1.5 acres on the Mining and Reclamation Plan Maps. The maps must be revised <br />to show that the amended area is 1.4 acres in size. <br />As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies <br />prior to March 15, 2012, it will be your responsibility to request an extension of time to allow <br />for continued review of this application.
