Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. In the letter dated December 12, 2011, the Division asked the Applicant to specify how the <br />pit walls would be reclaimed to 3H:1V using wet mining methods. The Applicant did not <br />include this information in the response received on February 2, 2012. Please describe how <br />you will ensure the reclaimed slope will be at a 3H:1V grade when the pit walls are <br />submerged by groundwater. <br />2. The typical cross section of the Flood Control Berm provided on the Mining and <br />Reclamation Plan Maps shows the reclaimed grade will be 3H:1V from five feet above and <br />five feet below the anticipated static water level. Rule 3.1.5(7) requires that slopes not be <br />steeper than 3H:1V from five above and ten feet below the anticipated static water level. <br />Therefore, the Applicant must revise the maps to show the reclaimed slope will be no steeper <br />than 3H:1V ten feet below the water level. <br />3. The Applicant has stated a berm will be constructed on the north and south sides of the <br />affected area. The Mining and Reclamation Plan maps show that the berm will be <br />constructed around the entire perimeter of the affected area. Please clarify if the berm will be <br />constructed only on the north and south sides of the affected area or around the entire pit.
