Compliance With Mine Plan N - Support Facilities Not On-site <br /> N -Other N - Special Categories Of Mining <br /> N -Processing Waste N -Topsoil <br /> COMMENTS <br /> INTRODUCTION -This was a partial inspection of the Elk Creek Mine conducted by Brock Bowles of the <br /> Colorado Division of Reclamation, Mining and Safety on February 8, 2012. Jim Kiger, Environmental Manager <br /> for Oxbow Mining, LLC (OMLLC)was present for the inspection.Weather conditions were overcast and cool. <br /> The ground conditions in the facility areas were damp. Hubbard Creek Road and Bear Creek Road above the <br /> fansite were inaccessible due to snow and muddy conditions. <br /> AIR RESOURCE PROTECTION—Rule 4.17: <br /> The stacking tubes were not in operation at the time of inspection. There was a large amount of coal in the <br /> stockpile and a dump truck was hauling and dumping coal waste on the II West Valley Fill (photo 1). There were <br /> no signs of fugitive dust on site or off. <br /> AVAILABILITY OF RECORDS —Rule 5.02.4(1): <br /> All files were available for review at the OMLLC office. See attached Availability of Records checklist. <br /> EXCESS SPOIL and DEVELOPMENT WASTE—Rule 4.09 Placement; Drainage Control; Surface <br /> Stabilization: <br /> The II West Valley Coal Refuse Pile appeared to be stable. There were no signs of cracking or slumping. <br /> The most recent backfill lift was topsoiled,graded and seeded last fall(photo 2). <br /> EXPLOSIVES—Rule 4.08 Distance Prohibitions 4.08.4;Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br /> The area around the detonation caps and explosive lockers were clear of vegetation and debris. <br /> HYDROLOGIC BALANCE -Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br /> 4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br /> Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage —Acid and Toxic Materials 4.05.8; <br /> Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br /> Number of Partial Inspection this Fiscal Year: 5 <br /> Number of Complete Inspections this Fiscal Year: 3 <br /> Page 2 of 7 <br />
