PUBLIC NOTICE
Hayden Gulch Terminal LLC (HGT), 37796 Routt County Road 53, P.O. Box 670, Hayden, Colorado 81639,
is requesting partial release of Phase I bond liability on a portion of the total 391.3 acres within the permit
boundary of the Hayden Gulch Loadout ( CDRMS Permit No. C-92 -081, approved April 22, 1993). HGL is
applying for Phase I release (SL -03) on 11.9 acres. Currently, a reclamation bond in the amount of
$1,557,769.56 is in place of which $488,408 are being requested for release.
The Hayden Gulch Loadout is located approximately two (2) miles south of the Town of Hayden, Colorado
off of Routt County Road 53. The total permitted area, including the Tie - Across Haul Road, the rail spur,
and the facilities area is approximately 391.3 acres. The permitted disturbed area contains 202.1 acres.
Surface ownership is predominately private, with right of entry based on a variety of private leases, subleases
and easements. The permit area also includes limited areas of state controlled surface.

Pursuant to Rule 3.03.1, a permittee may request Phase I Bond release upon successful completion of
backfilling, regrading and drainage control in accordance with the approved reclamation plan. For the
purposes of this Phase I Bond Release request, the term "reclaimed" means those disturbed areas where
successful completion of backfilling, regrading and drainage control, in accordance with the approved
reclamation plan, has been completed. The areas requested for bond release underwent structure
demolishment, backfilling and grading in 2011 in accordance with the Colorado Division of Reclamation,
Mining and Safety rules and regulations.
A copy of the SL -1 Phase I Bond Release application is available for public inspection at the Hayden Public
Library, 201 E. Jefferson Avenue, Hayden, Colorado 81639. Written comments or objections or requests for
public hearing or informal conference concerning this application may be submitted to, and additional

Comments must be received within 30 days of the last publication of this notice or within 30 days of the
