• Toxic or acidic chemicals used in extractive metallurgical processing are <br />present on site; <br />"Environmental Protection Plan" means a plan submitted by a designated <br />mining operation for approval as part of the Operator's or Applicant's permit <br />for such operation pursuant to rules promulgated by the board for protection <br />of human health or property or the environment in conformance with the <br />duties of operators as prescribed by this article. <br />In addition, the CMLRA § 34- 32- 112.5(2) C.R.S. provides for exemption of a mine <br />from DMO status if: <br />C \ Users \cwoodwardibesktop \Sundays \FINAL - Environmental Protection Plari Sunday Mines Revised January 2012 docx <br />Section 1 <br />Introduction <br />This document provides an EPP for the Sunday Mines Group. Although, the five <br />mines are currently permitted with individual state mine permits, this document <br />addresses environmental protection at all five mines. This document is submitted as a <br />permit amendment to each of the five existing permits to most - efficiently comply with <br />the Division designation. <br />1.3 Regulatory Framework <br />The Colorado Mined Land Reclamation Act (CMLRA) § 34 -32 Colorado Revised <br />Statutes (C.R.S.) was amended via Colorado HB 1161 as signed into law by the <br />Governor on May 20, 2008. The revised statute changed the definition of a DMO to <br />include all uranium mine operations including conventional underground uranium <br />mines such as the Sunday Mines Group. <br />As defined by the CMLRA § 34 -32 -103 (3.5)(a) C.R.S., a designated mining operation <br />means mining at which: <br />• Acid- or toxic - forming materials will be exposed or disturbed as a result of <br />mining operations; or <br />• Uranium is developed or extracted, either by in situ leach mining or by <br />conventional underground or open mining techniques. A uranium mining <br />operation may seek an exemption from designated mining operation status in <br />accordance with § 34 -23- 112.5(2) C.R.S. <br />The Colorado Mined Land Reclamation Board (Board) has not yet promulgated the <br />revised administrative rules that address the expanded definition of DMOs to include <br />all uranium mines as set forth in Colorado HB 1161. Therefore, specific direction <br />regarding compliance with Colorado HB 1161 for conventional uranium mines is not <br />yet present in the Mineral Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Hard Rock, Metal, and Designated Mining Operations <br />(HRMMR). <br />This classification of the Sunday Mines Group as a DMO requires the preparation of <br />an EPP for the Sunday Mines Group. An EPP is defined by the CMLRA § 34 -32 -103 <br />(4.9) C.R.S.: <br />1 -2 <br />
