Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve, with conditions, <br />an application for a permit to conduct coal mining and reclamation operations, i.e. a coal loadout <br />and railroad spur facility. The application was submitted by CAM Colorado, LLC for the Fruita <br />Loadout. This decision is based on a finding that the operations will comply with all <br />requirements of the Colorado State Program as found in the Colorado Surface Coal Mining <br />Reclamation Act, Section 34 -33 -101 et seq., C.R.S., and the Regulations promulgated pursuant <br />to the Act. If no request for a formal hearing is made within thirty (30) days of the first <br />publication of the issuance of this proposed decision, then this decision becomes final. Upon <br />submittal of acceptable surety by the applicant, the permit will be issued. The permit <br />application, all supporting documentation and any stipulations or conditions will become a <br />binding part of the permit. <br />Stipulations to Permit: <br />STIPULATION NO.1 <br />PRIOR TO INITIATING ANY DISTURBANCE AT THE FRUITA LOADOUT, CAM - <br />COLORADO, LLC MUST OBTAIN THE FOLLOWING PERMITS AND SUBMIT THEM TO <br />THE DIVISION FOR INCORPORATION INTO THE PERMIT APPLICATION PACKAGE: <br />1. COLORADO DISCHARGE PERMIT SYSTEM (CDPS) STORMWATER <br />CONSTRUCTION PERMIT. <br />2. UPDATED AND COMPLETE MESA COUNTY MAJOR SITE PLAN WITH <br />DOCUMENTATION THAT ALL CONDITIONS OF THE MESA COUNTY <br />PERMIT ARE COMPLIED WITH. <br />3. ANY OTHER PERMIT THAT MY BE REQUIRED FOR CONSTRUCTION AND <br />OPERATION OF THE FRUITA LOADOUT FACILITY. <br />
