Introduction <br />This document is the decision package prepared by the Colorado Division of Reclamation, <br />Mining and Safety (the Division) for the Fruita Loadout. This document includes: 1) the <br />proposed decision to approve the application; 2) a summary which includes a history of the <br />review of the permit application, a description of the environment affected by the operation and a <br />description of the mining and reclamation plan; and 3) the written findings of compliance the <br />Division has made as required by the Colorado Surface Coal Mining Reclamation Act. Detailed <br />information concerning the findings of compliance can be found in the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. <br />The Division has received an application for a permit to conduct coal loadout and reclamation <br />operations at the Fruita Loadout. The application was submitted by CAM - Colorado, LLC. The <br />coal loadout will be operated by CAM - Colorado, LLC. The coal loadout is located on privately <br />owned lands within Mesa County, Colorado. The legal description of the lands included within <br />the permit area is: <br />Township 1 North, Range 3 West, Ute P.M. <br />Section 2: Portions of the SWA, W /2SW /4SE /4 <br />Section 3: Portions of the SEA, SE /4SE /4NE /4 <br />Section 10: Portions of the N /2NE /4 <br />Section 11: Portions of the N /2NW /4, N /2NE /4, SEANEA <br />The proposed Fruita Loadout permit boundary contains 215.6 acres of land that is all located on <br />private surface. CAM - Colorado, LLC owns 208.3 acres, the Union Pacific Railroad owns 5.3 <br />acres, and Fruita Development LLC owns 2.0 acres. The minerals within the proposed permit <br />area are owned by the respective private surface owners. CAM - Colorado, LLC proposes to <br />disturb 38.1 acres within the permit area. <br />
