Diversions and Conveyance of Overland Flow <br />The Division does not propose to approve the use of an asphalt, a concrete, or <br />lining for a permanent diversion (4.05.3(3)). <br />2. The Division does not propose to approve construction of a diversion on an <br />existing landslide (4.05.3(5)). <br />C. Stream Channel Diversions <br />The Division does not propose to approve the diversion of an ephemeral <br />stream draining at least one square mile, an intermittent, or a perennial stream <br />(4.05.4(1) and (4)). <br />2. Channel lining structures and artificial channel roughness structures are <br />proposed for use to control erosion. These means are proposed to be approved <br />by the Division since they are necessary to control erosion, they are stable and <br />will require infrequent maintenance (4.05.4(2)(a)). <br />D. Sedimentation Ponds <br />1. The Division does not propose to approve the location of a sediment pond in a <br />perennial stream (4.05.6(1)(b)). <br />2. The Division does not propose to approve the submittal of reports required by <br />Rule 4.05.6(13) on other than a quarterly basis. <br />3. Alternative design criteria and specifications have not been approved for use <br />in sediment pond design and/or construction (4.05.6(11)). USFWS <br />conservation measures require that the sediment ponds be lined to prevent <br />seepage of water and dissolved constituents and mobilization of contaminants <br />in pond substrates. The material used for the liner shall be approved by the <br />Division prior to installation and the liners shall be regularly inspected and <br />replaced immediately if they are damaged. Detailed design specifications for <br />the sediment pond liners is provided in Exhibit 20 of the PAP. <br />E. Acid - forming and Toxic - forming Spoil <br />No mining is proposed for the loadout facility. There will be no acid- or toxic <br />forming spoil or underground development waste. <br />F. Impoundments <br />No specific approvals granted. <br />24 <br />
