INSURANCE <br />equipment has been moved onto the site. Any delays or interruptions caused by <br />you or others, where we cannot work will be charged at an hourly rate plus <br />material. <br />• SSI will install the wall to its required depth, or refusal, whichever occurs first. <br />• A representative must be provided on the job to approve field logs, field invoices, <br />and to make "on the spot" decisions on unforeseen situations. <br />• Proposal price based on subsurface soil information provided. <br />• No printed form provisions shall obligate or change the rights of SSI without <br />express notification herein. <br />No sales tax is included. If a sales tax exempt certificate is not provided, sales <br />tax must be charged. <br />• Proposal based on a site safety level of "D ". <br />• No payment & performance bond is included. <br />• All items based on working M -SAT, 6 days per week, 10 hours /day, using union <br />labor. <br />• We shall be entitled to rely, as accurate and sufficient, upon any boring and <br />other sub - surface analysis and information which we may be given or referred to <br />by or on behalf of you, the architect, engineer, and /or the owner. <br />• We will not be responsible for any costs incurred by others in the performance of <br />this contract, including services, materials, and equipment furnished by you, <br />unless previously agreed to in writing. <br />All claims disputed, and other matters in question arising out of the performance <br />of this contract which cannot be mutually resolved shall be submitted to the <br />American Arbitration Association to be resolved in accordance with Construction <br />Industry Arbitration rules, and judgement on any arbitration award may be <br />entered in any court of competent jurisdiction. <br />• This proposal is made for your acceptance within thirty (30) days from date of <br />this proposal - provided an acceptable contract is agreed upon. After such time, <br />it shall be void unless extended in writing by us. <br />• No item of this proposal shall be waived or amended, except in writing signed by <br />us. <br />• You may elect to treat this proposal as an offer and indicate your acceptance on <br />the provided line and return an original signed copy to us within the thirty day <br />time period specified above. Thereupon, the terms and conditions hereof, <br />together with the applicable plans and specifications for the referenced project, <br />shall constitute the complete contract between us. Your signature constitutes <br />both Notice of Award and Notice to Proceed. <br />The terms and conditions of the proposal shall be deemed part of the final <br />contract. <br />We exclude all forms of insurance other than those listed on the certificate. <br />PAYMENT TERMS <br />
