The Applicant has submitted a letter from the landowner requesting that a number of <br />structures remain after mining and reclamation are complete. The Division approved <br />Technical Revision No. 4 on June 21, 1999, which allowed structures which had the proper <br />permits or were constructed prior to the issuance of permits to remain on the property once <br />mining and reclamation are complete. It is the Permittee's responsibility to demonstrate to <br />the Division that the structures which have been requested to remain onsite are compatible <br />with the local zoning ordinances. The Applicant may submit documentation from the <br />Boulder County Land Use department which demonstrates the structures may remain onsite. <br />The Division must bond for the demolition of the structures until such documentation is <br />received. <br />5. The Division approved Technical Revision No. 3 on June 14, 1994, which addressed the <br />reclamation of drill holes. Please clarify if all of the drill holes and drill pads within the <br />permit boundary have been reclaimed. If there are drill holes /pads which remain to be <br />reclaimed, then please specify the number of drill holes, the depth and diameter of the drill <br />holes, whether ground water was encounter and at what depth, and the total surface area <br />disturbance associated with the drill pads. <br />Please remember that the decision date for this application is January 28, 2012. As previously <br />mentioned, if you are unable to provide satisfactory responses to any inadequacies prior to this <br />date, it will be your responsibility to request an extension of time to allow for continued <br />review of this application.
