A "Reason to Believe" letter was sent to the operator on September 22, 2011 indicating the 1.13 <br />acres was a possible violation pursuant to C.R.S. 34- 32.5- 116(4) for failure to protect areas outside of the <br />affected land from slides or damages occurring during the mining operation. The operator executed an <br />agreement on consent agenda forms, dated September 28, 2011 and Novemberl 8, 2011 (corrected form), which <br />suspend all but $100.00 of civil penalty if the operator complies with the corrective actions recommended by the <br />staff. The corrective action is to submit and receive approval of an application for either an Amendment or <br />conversion that encompasses all affected lands. The operator has paid the $100.00 civil penalty and has <br />submitted an application to convert the permit to a 112. <br />
