Pmeda <br />Director <br />On September 30, 2011 the Division of Reclamation, Mining, and Safety notified all uranium mining <br />operations that the y must comply with the Act and Rules requiring an EPP for Designated Mining <br />Operations. One of the options the Division gave operators was to submit an EPP amendment by no <br />later than October 1, 2012. On November 30, 2011 Cotter Corporation submitted an EPP submission <br />schedule for the above reference permitted sites. The Division notes that an EPP is currently under <br />review for the JD -8 Mine, M- 1984 -014. However, the submission plan for the other sites is inadequate <br />for the following reasons: <br />1. The plan as presented cannot be accepted. As proposed, the first date of submission for EPPs is <br />30 days after the notice required date of October 1, 2012 and the last date extends well into <br />2016. The JD -6, JD -8, JD -9, and SM -18 mines were already being pursued for DMO classification <br />in 2006 prior to the passage of HB -1161 in 2008. Therefore, Cotter is required to submit all EPPs <br />as outlined in the notice requirements by no later than October 1, 2012. <br />2. The schedule notes that final reclamation will begin on the SR -13A, M- 1977 -311 by October 1, <br />2012. Recent inspection observations of this site indicate it is fully reclaimed and releasable per <br />the approved reclamation plans and annual reports from 2003 indicate the site was "fully <br />reclaimed that year ".
