2011 Weed, Pest and Disease Inspection <br />During my inspections of the site in 2011 I did not identify any disease conditions at any <br />of the reclaimed or revegetated areas of the coal mine permit area. I did not identify any <br />plant pests which had affected the growth of the vegetation during this growing season. <br />No areas which experienced any infestation or blight were found during the inspections. <br />No patches of noxious weed species were observed, nor were any areas observed where <br />weeds, plant pests, or disease showed a deleterious effect to the live vegetation. <br />Oakridge Energy contracted for spraying of scattered noxious weeds in 2011 at the site. <br />The most recent spraying took place during the autumn of 2011. <br />f). Permanent revegetation as described in the mining and reclamation plan has occurred <br />at the Carbon Junction Mine at all disturbed areas of the mine slated for revegetation. <br />Additional Information <br />The following CDRMS permitting actions or revisions were undertaken in 2011. <br />Phase III Bond Release Application (SL - 04) <br />On July 30, 2008 an application for Phase III bond release was submitted to CDRMS. <br />This application seeks release for successful final reclamation at the North Pit, North Pit <br />Haul Road, Topsoil Stockpile #2, the Previously Reclaimed Spoils Area, South Pit Drill <br />Pad, Equipment Yard, Topsoil Stockpile #7, and ancillary areas at the mine under CRS <br />34- 33- 125(9)(c) and Rule 3.03.1(2)(c). The Division initially found the application <br />incomplete on September 26, 2008, and with the submittal of a certification statement, <br />found the application complete on October 10, 2008. CDRMS conducted the on -site bond <br />release inspection on October 29, 2008. The Division has expressed concerns that an <br />adequate demonstration that the post- mining land use of residential use has not been <br />implemented, while Oakridge Energy, Savage and Savage, and Goff Engineering and <br />Surveying contend that by platting and recording 35 acre parcels with the State of <br />Colorado and La Plata County the post- mining land use has been implemented. <br />A final decision for partial approval of the bond release by CDRMS was tendered in 2011. <br />Division staff proposed to approve Phase 1 and II bond release for all areas of the mine, <br />but denied the requested Phase III release based on the assertion that the approved post - <br />mining land use of "residential" had not been sufficiently implemented to allow release. <br />Oakridge disagreed and appealed the decision to the Colorado Mined Land Reclamation <br />Board. The Board agreed that all reclamation had been adequately completed for a final <br />release but agreed with the staff that the "residential" post- mining land use had not been <br />sufficiently implemented to allow final release. The decision to partially approve the bond <br />release was final June 10, 2011. <br />Minor Revision 7 <br />Minor Revision 7 was submitted to the Division August 9, 2011 to address the <br />construction of a road to be used for commercial development by Oakridge Energy, a <br />portion of which is located within the coal permit boundary.
