Western Fuels updated Map 2.04.7 -1 in the submittal dated May 26, 2011 to show all of the sub laterals. <br />However, are all of the irrigation ditches and their branches also shown on Map 2.04.7-1? Please refer to <br />question no. 13 in this section. <br />The Division has no further concerns. In the November 29, 2011 submittal, Western Fuels responded that all <br />of the irrigation ditches and sublaterals are shown on Map 2.04.7 -1. <br />9. On page 21 of the Probable Hydrologic Consequences discussion of Section 2.04.7, it is stated that the 2 " <br />Park Lateral irrigation ditch water will be put into a pipeline and diverted around the mine site. After <br />mining, the original ditch would be reestablished. Please point out which maps show the proposed location <br />of the pipeline. <br />As stated in their May 26, 2011 submittal, Western Fuels will provide the requested map when the ditch <br />relocation report is completed. <br />13. In Table 2.04.7 -5 on page 17 of Section 2.04.7, surface water monitoring station SW -N205 is described as <br />being inflow for Glasier Draw. However, referring to the topographic contour lines on Map 2.04.7 -1, it <br />appears that runofffrom this site would flow southwest into Meehan Draw, rather than into Glasier Draw. <br />Please explain. <br />The Division has no further concerns. In the submittal dated May 26, 2011, Western Fuels responded that <br />SW -N205 is located on an irrigation ditch which flows northward. The irrigation ditch appears on Map <br />2.04.7 -1 of the November 29, 2011 submittal. <br />15. Additional water monitoring data from the New Horizon No. 1 Mine was added to Appendix 2.04.7 -2 in the <br />May 26, 2011 submittal. However, please explain why baseline surface water monitoring data from the New <br />Horizon No. 2 Mine that is referenced in the New Horizon North permit application was not submitted as <br />well. <br />Western Fuels continues to submit monitoring results for surface water monitoring sites SW -N1 and SW- <br />N3. These two sites are part of the NHN monitoring program. <br />2.05.3(4) — Ponds, impoundments, other treatment facilities and diversions <br />2. On page 6 of Section 2.05.3(4) of the May 26, 2011 response, Western Fuels confirmed that the 2 " Park <br />Lateral ditch is the same as the Colorado Cooperative Company ditch. Western Fuels also states that they <br />are in the process of getting approval from the ditch company for relocation of the irrigation ditch. Please <br />provide a copy of the agreement for insertion into the permit application. <br />In their November 29, 2011 submittal, WFC stated that a copy of the CCC agreement will be sent to the <br />Division when it has been executed. <br />3. In the May 26, 2011 response, WFC stated that an engineer's certification was located in the permit <br />application just before the SEDCAD designs. However, the Division cannot find this engineer's <br />certification. Please point out exactly where this certification is located. <br />
