DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
Date: December 28, 2011
To: Marcia Talvite
From: Joe Dudash
b
RE: New Horizon h, Permit No. C- 2010 -088, Western Fuels Colorado LLC
New Permit Application, Surface Water Hydrology Adequacy Review Responses
I have finished my adequacy review of Western Fuels' responses, dated November 29, 2011, to the Division's
adequacy review letters dated September 12, 2011 and September 16, 2011 for the New Horizon North Mine.
The following is the status of my adequacy review questions and comments. The format and numbering are
from the Division's original adequacy review letter. Additional information is being requested by the Division.
2.04.7(2) — Surface Water Information
STATE OF COLORADO
Loretta E. Pineda
Director
1. A) In the section titled "Surface Water Monitoring" on pages 17 and 18 of Section 2.04.7,
"Hydrology Description ", it is unclear in the discussion which surface water monitoring sites are to be
included in the baseline monitoring program and whether they will continue to be monitored as part of
the operational monitoring program. As an example, there is a discussion of monitoring sites SCC and
NCC but it is not clear if they are part of the NHN baseline monitoring program since they do not appear
in Tables 2.04.7 -5, 2.04.7 -6 or 2.04.7 -7. As another example, monitoring sites SW -N1, SW -N3, SW -N6,
SW -N7 and NPDES 1 are mentioned as sites with historic data and are listed in Table 2.04.7 -5 under
"Historical Reference Data ", but the text states that it is anticipated that these five sites will be
monitored before disturbance. It is also not clear if "historical reference" in Table 2.04.7 -5 means
baseline. Please revise the discussion and Table 2.04.7 -5, if necessary, to make it clear which sites are
baseline monitoring sites, which sites are operational monitoring sites, and what "historical reference"
means.
Mike King
Executive Director
The Division has no further concerns. Section 2.04.7 was revised in the November 29, 2011 submittal.
John W. Hickenlooper
Governor
B) On pages 17 and 18 of Section 2.04.7, "Hydrology Description ", there appear to be several
typographic errors in the section titled "Surface Water Monitoring". In the first paragraph, "nine 14"
should be "14". In the same paragraph, it appears that SW -N11 should be SW -N211 and SW -N12
should be SW -N212. In the last paragraph of that section, it appears that SW -N13 should be SW -N213
and SW -N14 should be SW -N214. Please revise accordingly.
In the submittal dated November 29, 2011, WFC corrected most of the typographic errors. However, it
still appears that SW -N13 should be changed to SW -N213 and SW -N214 should be changed to SW-
N214. Please revise or explain why a revision is not needed.
6. In the May 26, 2011 submittal, Western Fuels explained that the monitoring of Nygren Draw will be
resumed before disturbance. Map 2.04.7 -1 was revised to include sites SW -N213 and SW -N214. The
Division requests that baseline monitoring of sites SW -N213 and SW -N214 continues for at least four
consecutive quarters.
Office of
Mined Land Reclamation
COLORADO
DIVISION OF
RECLAMATION
MINING
— &—
SAFETY
Office of
Denver • Grand Junction • Durango Active and Inactive Mines
