o The operator is responsible for informing all persons associated with this project that they <br />will be subject to prosecution for knowingly disturbing Native American Indian shrines, <br />historic and prehistoric archaeology sites, or for collecting artifacts of any kind, including <br />historic items and/or arrowheads and pottery fragments from Federal lands. <br />o Attached is the BLM seed mixture to be used for reclamation of the drill hole sites. <br />o During wet weather conditions, no mud blading is allowed. When road conditions are <br />such that vehicles create ruts deeper than 4 inches, drilling and vehicle activities will be <br />temporarily suspended. <br />o Big game winter timing restrictions: December 1 to April 15. No activity is allowed <br />during this period. <br />o To protect special status bat species, limit activities to existing disturbance to the extent <br />possible and avoid cutting, damaging, or removing trees. Where vegetation treatment is <br />necessary or proposed, retain and avoid modifying identified cavity trees and other <br />hibernacula in the project area. Any incidental observations of bats or bat sign during <br />biological surveys will be documented in the project case file(s), and mitigation measures <br />will be applied as necessary. <br />o To protect special status reptiles, to the extent possible, observed reptiles or amphibians <br />will be avoided by project activities and will not be intentionally harmed. Additionally, to <br />the extent possible, project activities will avoid disturbing known or potential <br />hibernacula. Any incidental observations of reptile or amphibian or sign during biological <br />surveys will be documented in the project case file(s), and mitigation measures will be <br />applied as necessary. <br />o To minimize impacts on migratory bird populations, it is recommended that no surface <br />disturbing activities occur from May 15 through July 15. This timeframe encompasses <br />the core breeding season for the majority of migratory birds in the project area. Project <br />activities shall retain and avoid modifying identified cavity trees, snags, and perches in <br />the project area. <br />o To protect adjacent undisturbed native vegetation, all activities will stay confined to <br />existing disturbed areas as much as possible and reclamation/ reseeding of disturbances <br />shall occur concurrently with backfilling of drill holes. Exception - if holes were drilled <br />in the middle of existing access road, backfilling and re- compaction of surface consisting <br />of the road will be sufficient. <br />o A Storm Water Prevention Plan (SWPP) and permit is required by the State of Colorado, <br />for actions that collectively disturb more than 1 surface acre. The surface area disturbed <br />by exploration operations, and final land reclamation planning will be consistent with the <br />approved SWPP. <br />o For all newly disturbed areas, including, drill pads, and pits, site specific locations shall <br />be selected to minimize soil cut and fill volumes.
