B. ISSUES NOT WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />1. "Last year the sheriff called to tell me that the miners had filed a complaint against <br />me for using an egress access across the corner of the mining property to my <br />property. This egress has been used by my family for seven generations." <br />Division of Reclamation, Mining and Safety (DRMS) Response: <br />The jurisdiction of the Division and the Board does not extend to land use decisions, <br />visual or economic impacts, noise, traffic, dust not caused by eroding berms or spoils <br />piles, or other nuisances or socioeconomic issues. Local government, through the <br />local land use and planning and permitting process, handles these issues. <br />2. "Automatic rifle fire can go on for hours and days. It is hard to explain the difference in the valley <br />when they are shut down verses the amount of noise these guys can make when <br />they are running. I have worked at mine mills that make less noise than this nine <br />site. "I expect the use of light will be increased as well These miners should be required <br />to focus their work lights to the work area only with peripheral shading to prevent <br />light contamination of the area.
