19- December -2011 <br />Mr. Kent Gorham <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />303 - 866 -3567 <br />RE: LINC ENERGY OPERATIONS, INC. <br />NOTIFICATION OF INTENT TO EXPLORE FOR COAL BY DRILLING; File No. X- 2011 - 235 -00 <br />SUBMISSION OF DEFICIENT INFORMATION —T &E STUDY AND ACCESS AGREEMENT <br />Dear Mr. Gorham: <br />On October 17, 2011, Linc Energy Operations, Inc. (Linc Energy) received a letter from you indicating <br />that two items were deficient in the NOI- 2011 - 235 -00 application. The two deficient items in the NOI <br />application included a (1) Right of Entry and a (2) Threatened and Endangered (T &E) species statement. <br />Both of these deficiencies have been addressed by Linc Energy and the information is included herein. <br />Linc Energy has obtained permission to access surface lands to conduct environmental and drill planning <br />related work from the Colorado State Land Board. Three copies of the Right of Entry or Access <br />Agreement document are attached to this letter. Please incorporate this agreement into Appendix C of <br />the Application submittal. <br />Linc Energy has also contracted a third party consulting firm to conduct a T &E species study and <br />statement pertaining to the ten proposed drill sites. The selected contractor, Habitat Management, Inc., <br />has prepared a thorough report which is attached to this letter. Please incorporate this report in <br />Appendix F of the Application submittal.
