° "nQ 1.14•..
December 6, 2011
Dear Mr. Gardner,
Best regards,
Lynne L. Bixler
Water Commissioner, WD42
DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Mark Gardner
Whitewater Building Materials
940 South 10 St.
PO Box 1769
Grand Junction, CO 81501 -1769
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
Bob W. Hurford, P.E.
Division Engineer
This letter is in response to our recent phone conversation concerning the diversion of East
Creek Ditch water into the McCurder gravel pit pond located near Whitewater. The current decrees for
the East Creek Ditch are for irrigation use only. However, when there is no river call being
administered below East Creek Ditch it is fine to divert any or all water from East Creek into the East
Creek Ditch and subsequently into the gravel pit pond even though the water will not be used for
irrigation.
I spoke with Travis Marshall from the Division of Reclamation, Mining and Safety. He was
under the impression there might be an issue with water quality. The Division of Water Resources
does not deal with water quality and thus has no issue with the current practice of diverting East Creek
Ditch water into the McCurder gravel pit pond.
Let me know if I can be of further assistance.
Water Division 4 • Montrose
P.
