Whitewater has contacted Lynne Bixler with the Colorado Division of <br />Water Resources about an affidavit on the diversion of water into this <br />lake. Lynn stated she would contact you directly and an affidavit is <br />included with this letter. I have contacted Mr. McCurter about the <br />discharge and he stated he fills the lake without discharging. I've also <br />attached his letter stating so. <br />2. None, The Division asked Whitewater to add the landowner improvements <br />to the permit via a Technical Revision so the items on the ground matched <br />the maps. There was no discussion on Whitewater accepting <br />responsibility for the construction or design of the landowner <br />improvements. Your request to now accept responsibility to prevent and <br />correct the "cut back" noted is unacceptable. We remind you that the Mr. <br />McCurter installed the inlets on lands reclaimed per our permit. <br />Whitewater was not consulted when Mr. McCurter used his property as he <br />wished and he sent you a notarized letter on 8/15/11 affirming his property <br />rights. If he feels the "cut back" areas need work then it is his <br />responsibility to fix them. <br />DEC 1 92011 <br />
