SAND & GRAVEL PRODUCTS
Phone 242 -7537
December 18, 2011
Travis,
WHITEWATER BUILDING MATERIALS CORPORATION v
940 South 10th Street, P.O. Whitewater has contacted Lynne Bixler with the Colorado Division of
Water Resources about an affidavit on the diversion of water into this
lake. Lynn stated she would contact you directly and an affidavit is
included with this letter. I have contacted Mr. McCurter about the
discharge and he stated he fills the lake without discharging. I've also
attached his letter stating so.
2. None, The Division asked Whitewater to add the landowner improvements
to the permit via a Technical Revision so the items on the ground matched
the maps. There was no discussion on Whitewater accepting
responsibility for the construction or design of the landowner
improvements. Your request to now accept responsibility to prevent and
correct the "cut back" noted is unacceptable. We remind you that the Mr.
McCurter installed the inlets on lands reclaimed per our permit.
Whitewater was not consulted when Mr. McCurter used his property as he
wished and he sent you a notarized letter on 8/15/11 affirming his property
rights. If he feels the "cut back" areas need work then it is his
responsibility to fix them.
DEC 1 92011
