3. The NOI proposes to reclaim the 0.58 acres area identified as "future disturbance ", but <br />does not provide reclamation for other areas to be affected by the operation. Pursuant <br />to the Act and Rules, reclamation is required for all affected lands. Please revise the NOI <br />to provide reclamation for all affected lands. <br />4. The application indicates the existing waste rock stockpile will be expanded by 0.58 <br />acres and available topsoil will not be salvaged from the expansion area. The topsoil for <br />the expansion area is inconsistent and ranges from 0 to 10 foot depth. Pursuant to Rule <br />3.1.9 and 3.1.10, the Division requires salvage and safeguarding of the available topsoil <br />for reclamation purposes. Please revise the NOI to affirmatively state the available <br />topsoil will be salvaged and safeguarded for reclamation purposes, as required by the <br />Act and Rules. Please estimate the depth and area(s) of topsoil replacement during <br />reclamation of affected lands. <br />5. The application commits to stabilization of over - steepened slopes but does not clarify <br />the configuration of reclaimed slopes or how stabilization will occur. Please clarify the <br />final slopes of the reclaimed affected lands. <br />6. The application indicates the existing sediment pond will be a permanent structure and <br />not removed during final reclamation. Please address the requirements of Rules <br />3.1.5(7) and 3.1.6(1)(a). <br />7. Please propose a financial warranty which addresses reclamation for all affected lands <br />and the requirements of Rule 3.1.7(8). <br />Subsequent to review of the Applicant's response to these deficiency issues the Division may <br />identify additional deficiency issues. As noted above, the Applicant has 60 days, until February <br />11, 2012, to address all deficiency issues to the Division's satisfaction. <br />Sincerely, <br />Wallace H.
