The Division received no comments. <br />Please be advised the NOI for the Oyama Tunnel Exploration Project is deficient and the <br />proposed activities may not proceed until all deficiency issues have been addressed to the <br />Division's satisfaction. Pursuant to Rule 5.1.3(b), if the following deficiency issues are not <br />addressed to the Division's satisfaction within 60 days, by February 11, 2012, the Division may <br />terminate the NOI for the Oyama Tunnel Exploration Project. <br />1. The NOI indicates affected lands will be reclaimed to support mining post- mining land <br />use. Please note "mining" is not one of the options provided under Rule 3.1.1. Please <br />revise the NOI to affirmatively state affected lands will be reclaimed to one of the <br />beneficial post- mining land uses provided under Rule 3.1.1, and provide a reclamation <br />plan which supports the selected post- mining land use. <br />COLORADO <br />D I V I S I O N O F <br />RECLAMATION <br />MINING <br />—&— <br />SAFETY <br />2. The application form proposes 0.58 acres affected lands. Figure 2, Site Map, and Figure <br />A -3, Project Survey Map, label the 0.58 acre area as future disturbance and delineate a <br />2.60 acre permit boundary. Please clarify the difference between affected lands and the <br />permit boundary. Application documents indicate the proposed activities will utilize the <br />existing sediment pond, the existing portal, portions of the existing waste rock stockpile, <br />and possibly additional areas to support the proposed activities. Pursuant to Rule <br />1.1(4), such areas are defined as affected lands, but such areas are not included within <br />the proposed 0.58 acre boundary of affected lands. Please increase the declared <br />affected lands to include all surface areas to be affected and /or re- affected by the <br />proposed prospecting operation, in accordance with Rule 1.1(4). <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
