The map submitted with Amendment Application seems to indicate that 9.9 acres of <br />groundwater will be exposed. Please state the maximum amount of groundwater which will <br />be exposed during the life of the mine. Also, revise the Mining Plan Map and the <br />Reclamation Plan to show the maximum amount of groundwater which will be exposed. <br />6.3.6 Exhibit F — List of Other Permits and Licenses Required <br />13. The Applicant has stated that no other permits are required for this operation. Please state <br />whether or not a permit from Morgan County is required. In addition, the applicant must state <br />that a well permit has been obtained for this operation. <br />14. The Applicant has stated the evaporative losses of exposed groundwater are covered by a <br />well permit and the substitute water supply plan provided by the Colorado Division of <br />Wildlife. According to the comments provided by the Division of Water Resources (see <br />enclosed copy), if more than 8.5 acres of groundwater will be exposed, then a new well <br />permit will need to be obtained. Please affirmatively state that you will obtain a new well <br />permit prior to exposing more than 8.5 acres of groundwater. <br />6.3.7 Exhibit G — Source of Legal Right -to -Enter <br />15. The Applicant must provide a description of the basis for the legal right of entry onto the <br />amended area and to conduct mining and reclamation. This may be a copy of access lease, <br />deed, abstract title, or a current tax receipt. <br />6.3.8 Exhibit H — Municipalities Within a Two -mile Radius <br />No comment. <br />6.3.9 Exhibit I — Proof of Filing with County Clerk <br />No comment. <br />6.3.10 Exhibit J — Proof of Mailing of Notices to Board of County Commissioners and Soil <br />Conservation District <br />No comment. <br />6.3.11 Exhibit K — Terms of Governmental Contract <br />No comment. <br />
