The following comments are from the Special Use Permit SUP 2011 -009 received from
Pueblo County November 2011. Please see AGENCY COMMENTS below:
AGENCY COMMENTS
"Comments received from the Army Corps of Engineers (Exhibit 13 — Comments from the Army
Corps of Engineers) state in part, "Based on your description of the proposed work, other
information available to us, and current regulations and policy, we have determined that this
project will not involve any of the above activities. Therefore, it will not require Department of the
Army authorization under the above laws. "In a phone call from Christopher Grosso, Regulatory
Project Manager with the Army Corps of Engineers, it was stressed that the applicant should be
aware that these comments relate only to the rock picking and should the applicant do anything
else, such as place the future residence near Greenhorn Creek, the Army Corp will want to review
the project again.
Comments received from the Colorado Division of Parks and Wildlife state in part, "After reviewing
the maps and documents for the mining location District Wildlife Manager Jeremiah Johnson and
the Colorado Division of Parks and Wildlife feels that the impacts on wildlife will be minimal if the
mining takes place as described in the application."
Comments received from the Colorado Department of Transportation state:
1. The Haul Route is acceptable.
2. The applicant's commitment to the number of units proposed to transport the material is
acceptable.
3. The size of trucks used as well as their schedule of usage is acceptable.
The sight distance at the location where the truck traffic will enter SH 65 is sufficient.
No application for a State Highway access permit will be required. We would request a copy of the
final approved permit for CDOT records."
