MANAGEMENT <br />The DRMS' letter dated November 23, 2011 transmitted its adequacy review for the <br />referenced technical revision. On behalf of Bear Coal Company, Inc., following are its <br />responses to the DRMS' comments and concerns: <br />1. DRMS - On Drawing 11 -4, please add a note that the pipelines from the treatment <br />pond and the pipeline that is proposed in TR -29 are buried. <br />Bear - The requested note was added to drawing 11 -4. <br />2. DRMS - Please consider realigning the intersection of the bermed ditch and the <br />proposed pipeline so that there isn't a sharp 90 degree turn, as is shown on <br />Drawing 11 -4. <br />Bear - A note was added to drawing 11 -4 that states the ditch and berm will be <br />realigned during the change over to the bypass line. <br />3. DRMS - In the Pond Inlet Detail on Drawing 11 -4, please explain the meaning of the <br />statement "Gravel Pad Remaining after Reclamation ". The Division is not aware of <br />any gravel pad that is permitted to remain after reclamation. <br />Bear - The subject note was removed from the drawing. <br />4. DRMS - In both the Primary Spillway Detail and the Emergency Spillway Detail on <br />Drawing 11 -4 there is a designation of the "Sediment Pond Level" shown where the <br />buried pipeline from the treatment pond goes down in elevation and then back up. <br />Please explain what this designation represents and whether or not the buried <br />pipeline actually dips down and, then, back up. <br />
