.. within the affected Moffat Area, the Mountain Shrub community has six <br />(6) perennial, native species: three (3) cool - season grasses, one (1) <br />grass -like species, and two (2) forbs. The sagebrush- snowberry <br />community has seven (7) perennial, native: species: three (3) cool- season <br />grasses and four (4) fortis. Chevron Mining, Inc. will reestablish <br />vegetation similar to the relative importantspecies with regard to life form <br />and seasonality rather than revegetating the area with species originally <br />.:_present. Finally,, Chevron Mining, Inc. will establish at least two (2) shrub <br />.,species in the Moffat.Area. The woody stem success standard has been <br />determined to be 1,000 stems per acre. <br />Information pertaining to development of revegetation success criteria for <br />areas without replaced topsoil was received from Chevron Mining, Inc. on <br />March 24, 1982. To satisfy the requirements of Rule 4.15.10(1) pertaining <br />to the revegetation success criteria for previously mined areas, Chevron <br />Mining, Inc. 'collected cover data along fifteen (15) transects. From these <br />transects, a mean vegetative cover of 47 percent was obtained. Therefore, <br />the revegetation success criteria for areas without replaced topsoil, <br />pursuant to Rule 4.15.10(1), is 47 percent vegetative cover. <br />The cover standard for riparian areas is 55 percent cover. Riparian areas <br />along Oak Creek were disturbed prior to August 3, 1977. No topsoil was <br />salvaged in these 'areas, and so diversity will be evaluated accordingly. <br />The Division finds that the cover standards, for non - topsoiled and riparian <br />areas are in compliance with the requirements of Rule, 4.15.10. <br />The Division approved of the reference areas which the applicant selected <br />based on the requirements of Rule 4.15.7(3). <br />The reference areas will be utilized to determine revegetation success in a <br />manner which the Division finds acceptable [Rule 4.15.7(4)]. <br />VII. Protection of:Underground Mining <br />-,The Division approved surface coal mining activities being conducted <br />within 500 feet of an active or abandoned underground mine. This <br />approval was based on the fact that approval for such was granted by Mine <br />: Safety and Health Administration (MSHA) and the (then) Colorado <br />Division of Mines. The variance was granted by MSHA based on the <br />thickness of material, vertically separating the current operation from <br />previous underground workings [Rules 4.19(1) and 4,22.4(1)]. <br />VIII.
