13. Stratman Well <br />On July 19, 2011, Transit Mix (TMoP) applied for a Gravel Pit Well permit to allow for <br />the expanded use of water at the Pueblo East operation. At the same time, TMoP <br />initiated a neighbor contact program to inform the well owners nearby of the operation <br />amendment. In addition, well owners within 600 feet of the mining limit were offered a <br />cistern filled with City of Pueblo water (at TMoP expense) and well monitoring during <br />the mining in Phase 7. Well owners were asked to agree in writing for a cistern and to <br />sign a SEO form waiving objections to the Gravel Pit Well permit application. All well <br />owners within 600 feet have signed the SEO form, except for Stratman. <br />Transit Mix (TMoP) has talked with Steve Stratman on several occasions to resolve his <br />concerns on the two wells. Kerry Sabott Community well is jointly owned (Steve <br />Stratman at 50 %, Kerry Sabott at 25 %, and Marlyn Chee at 25 %) and is within 600 feet <br />of the mining. The Stratman residence well is beyond 600 feet of the mining. <br />On August 4, 2011, Mark Klune, Bud Herskind and Andre Laroche of TMoP met with <br />Steve Stratman and Kerry Sabott at Mark's office in Pueblo to discuss planned Phase 7 <br />mining impacts to wells. Mark distributed TMoP Water Well Mitigation Contracts for a <br />cistern and SEO well permit waiver form. Stratman took Chee's contract and SEO well <br />permit waiver for her to review, since she was not present at the meeting. <br />Stratman was interested in the well quality sample results for his residential well (not in <br />the 600 ft excavation range) and for the Kerry Sabott Community well of which he is <br />50% owner. TMoP sent Stratman the lab results per his request the following day. No <br />comments have been received from Stratman on the testing results. <br />On August 17, 2011, Mark Klune, Bud Herskind, Andre Laroche, Paul Bruss (Water <br />Resource Engineer with Bishop Brogden Associates, Inc.), and Daniel O. Niemela (P.G. <br />Associate Hydrogeologist with Bishop Brogden Associates, Inc.) met with Steve <br />Stratman and Kerry Sabott at Mark's office in Pueblo to discuss planned Phase 7 mining <br />impacts to wells. Kerry Sabott signed the Transit Mix of Pueblo Water Well Mitigation <br />Contract and the SEO well permit waiver. Marlyn Chee has also signed both documents. <br />Shortly after the August 17 meeting, Mark Klune met with Stratman at his residence and <br />offered to install a cistern at his residence and haul city water (all at TMoP expense) even <br />though this residential well is not within the 600 ft range. Stratman gave no answer to the <br />offer. <br />In the following weeks, Mark Klune called Stratman on the telephone to discuss the <br />resolution on the two wells he owns, however Stratman advised he was busy and unable <br />to speak at the time. <br />4 <br />
