Environmental Scientists and Engineers, LLC <br />5.6 Paleontology <br />If cultural or paleontological resources are discovered during mining operations under <br />this lease permit, the licensee shall immediately notify the Field Office Manager and shall <br />not disturb such discovered resources until the Field Office Manager issues specific <br />instructions. <br />a. Within five working days after notification, the Field Office Manager shall <br />evaluate any cultural or paleontological resources discovered and shall <br />determine whether any action may be required to protect or to preserve <br />such discoveries. <br />b. The cost of data recovery for cultural or paleontological resources <br />discovered during mining operations shall be borne by the licensee, if the <br />licensee is ordered to take any protective measures. Ownership of cultural <br />resources discovered shall be determined in accordance with applicable <br />law. <br />5.7 Cultural Resources <br />A Class III Cultural Resource Inventory will be conducted for the entire proposed lease <br />area as part of developing the Mine Plan. Previous Class III inventory areas need not be <br />re- surveyed. The inventory would identify sites that need protection and mitigation. If <br />other cultural resources become apparent during mine construction and operation, the <br />BLM will be notified and appropriate mitigation will be implemented. <br />5.8 Threatened and Endangered Species <br />The lease area may now or hereafter contain plants, animals, or their habitats determined <br />to be threatened, endangered, or other special status species. BLM may recommend <br />modifications to mining plans to further its conservation and management objective to <br />avoid BLM - approved activity that will contribute to a need to list such a species or their <br />habitat. BLM may require modifications to or disapprove proposed activity that is likely <br />to result in jeopardy to the continued existence of a proposed or listed threatened or <br />endangered species or result in the destruction or adverse modification of a designated or <br />proposed critical habitat. BLM will not approve any ground- disturbing activity that may <br />affect any such species or critical habitat until it completes its obligations under <br />applicable requirements of the Endangered Species Act as amended 16 U.S.C. § 1531 et <br />seq., including completion of any required procedure for conference or consultation with <br />USFWS. <br />Surface mining of the Collom tract has the potential to result in minor water depletions to <br />the Yampa River. Water depletions from the Colorado River Basin are likely to <br />jeopardize the continued existence of the Colorado pikeminnow, humpback chub, <br />bonytail, and razorback sucker and result in the destruction or adverse modification of <br />their critical habitat.
