Additionally, "Other resource uses /values within this unit <br />are allowed consistent with coal, oil and gas resource development objectives" (page 37- <br />38, LSRMP -ROD, June 1989). <br />The proposed lease area is not presently leased for coal mining and falls within the area <br />designated for further consideration for coal leasing, based on the following criteria <br />applied in the LSRMP -ROD (Appendix 1). <br />• Interest in coal development expressed by industry <br />• Proximity to existing and proposed coal leases <br />• An area of coal exploration where resource data has been obtained <br />• Presence of potentially mineable coal seam or seams greater than 5 feet thick <br />with less than 15 percent dip <br />Lands in the proposed lease area "are acceptable for coal leasing consideration," subject <br />to the four screens required by 43 CFR 3420.1 (Appendix 2, LSRMP -ROD), including: <br />• Identification of lands with coal potential <br />• Initial evaluation under the coal leasing unsuitability criteria <br />• Multiple land use trade -offs <br />• Surface owner consultation <br />Coal unsuitability criteria were applied to the lands of the proposed lease area during <br />preparation of the LSRMP. The results of this review are described in Appendix 2 of the <br />LSRMP -ROD (1989). The work and information summarized in Section 3 and 4 of this <br />EA document takes into consideration the coal leasing unsuitability criteria. <br />1.6 Relationship to Statutes, Regulations, or Other Plans <br />Congress has established a policy of orderly and economic development of domestic <br />mineral resources to meet industrial, security, and environmental needs through several <br />laws such as: <br />• The Mineral Leasing Act of 1920 (30 U.S.C. 181 et. seq.) <br />• The Mining and Minerals Policy Act of 1970 (30 U.S.C. 21a) <br />• The Federal Coal Leasing Amendments Act of 1976 (90 Stat. 1083 -1092) <br />• The Federal Land Policy and Management Act of 1976 (43 U.S.C. 1701) <br />• The National Environmental Policy Act of 1969 <br />• The Surface Mining Control and Reclamation Act of 1977 <br />These policies have been affirmed and implemented through the regulations promulgated <br />at 43 CFR 3400. <br />The proposed lease area is located within a few miles of similar tracts that were analyzed <br />for the ColoWyo Mine.
