Walsh <br />Environmental Scientists and Engineers, LLC <br />regulations. The OSM recommends approval, approval with conditions, or disapproval of <br />the MLA mining plan to the Assistant Secretary - Land and Minerals Management. <br />Before the MLA mining plan can be approved, BLM and the surface - managing agency <br />(if other than BLM) must concur with this recommendation. <br />When the inter - agency review and approval process is completed, CDMG issues a permit <br />to conduct coal mining operations and enforces the performance standards and other <br />permit requirements over the duration of the permit. CDMG also has primary authority in <br />the event of any environmental emergencies. OSM retains oversight responsibility for <br />any CDMG enforcement action. BLM retains authority in those emergency situations <br />where CDMG or OSM cannot act before any environmental damage occurs. <br />1.4.3 Other Agencies <br />The applicant will comply with applicable regulatory requirements for future mining <br />operations in the federal coal lease area as required by the following jurisdictional <br />agencies: <br />Federal Agencies <br />• Environmental Protection Agency (EPA) — Compliance with applicable air, <br />water, and hazardous materials requirements under programs administered by <br />the Colorado Air Pollution Control Division (CAPCD) and Colorado Water <br />Quality Control Division (CWQCD) <br />• U.S. Army Corps of Engineers (COE) — Compliance with Section 404 of the <br />Clean Water Act as it relates to potential construction and stream realignment <br />• U.S.Commerce Department, Bureau of Alcohol, Tobacco, and Firearms — <br />Permits for procurement, transportation, storage, and use of explosives <br />• Mine Safety and Health Administration (MSHA) — Compliance with <br />applicable requirements relating to coal processing waste dams; <br />impoundments and sedimentation ponds; plans for underground disposal of <br />development waste, coal processing waste, or excess spoil; refuse piles; <br />reclamation and closure of mine openings; any discharges into underground <br />mines; mining within 500 feet of an active underground mine; and plans for <br />extinguishing coal mine waste fires <br />• U S. Fish and Wildlife Service (USFWS) — Compliance under the Endangered <br />Species Act, Bald Eagle Protection Act, and Migratory Bird Act <br />State Agencies <br />• Colorado Division of Minerals and Geology (CCDMG) — Compliance under <br />the State of Colorado Coal Mining rules <br />• Colorado Air Pollution Control Division ( CAPCD) — Compliance with <br />applicable air quality permitting and operational requirements <br />P: PROJFCTS Colon (.ISS FA Final nLM.N.
