Therefore, a description of the land use and local land use <br />classification of the adjacent area needs to be included in the permit. <br />Response — The response to this concern is found in the response to Item 2.04.3 # 5. <br />The wetland areas to the west of CR 26.00 downstream of Meehan Draw and the <br />irrigated pasture and wetland areas west of CR 26.00 adjacent to the Garvey property <br />are clearly shown on this map. Text has been added to include a description of the land use <br />and local land use classification of the adjacent area. See the previous response found above. <br />13. Grazingland <br />a) The "Grazingland" land use is discussed beginning on page 4 of Section 2.04.3 of the <br />PAP. The acreage given in the first paragraph is 163.69 acres, which conflicts with the <br />93.60 acres shown on Map 2.04.3 -1 — Land Use. Assuming the map acreages are <br />correct, please revise this paragraph to give the correct acreage (and percentage of the <br />permit area) and to indicate that Grazingland is the second largest land use category. <br />Response — The extent of Grazingland as discussed on page 4 of Section 2.04.3 <br />consists of the 65.55 acres of GL -REC; the 65.41 acres of GL-SB; the 28.19 acres of <br />GL -SI; the 4.09 acres of GL-RECS; the 0.38 acres of GL- RECSB; and the 0.07 acres <br />of GL DC; which totals 163.69 acres of Grazingland. Map 2.04.3 -1, New Horizon <br />North Mine -Land Use Map is correct in the acreages corresponding to the current <br />premining land uses found in the proposed NHNMine Permit area and is in perfect <br />agreement with the Grazingland acreage figure of 163.69 acres found on PAP page 4 <br />of Section 2.04.3. Grazingland is the largest premining land use found in this <br />permit area. Pastureland is the second largest land use found with the proposed <br />NHNMine Permit area. <br />The acreage figure of 93.60 acres which the DRMS has cited does appear on the <br />original Map 2.04.3 -1, New Horizon North Mine - Land Use Map, but this acreage <br />figure incorrectly included the reclaimed portion of the original NH1 Mine as <br />Pastureland. This error has been removed from Map 2.04.3 -1, New Horizon North <br />Mine - Land Use Map and the acreage figure for Grazingland found on page 4 of <br />Section 2.04.3 is correct. <br />b) In the second paragraph of the Grazingland section, a designation of Grazingland - <br />Reclamation (GL -REC) is described for certain areas of the original NH1 mine This <br />conflicts with the map notation, which shows Pastureland Topsoiled Reclamation (PL- <br />REC) for the NH1 areas. Please compare this text with Map 2.04.3 -1. If the Map is <br />correct, please move this paragraph to the "Pastureland" section which follows, and <br />revise the next -to -last sentence of this paragraph to refer to Pastureland... rather than <br />Grazingland. <br />Response — The notation Grazingland - Reclamation (GL-REC) does appear on the <br />original Map 2.04.3 -1, New Horizon North Mine - Land Use Map, but as we have <br />addressed in the narrative, Grazingland does not appear as a defined Land Use in the <br />DRMS regulations and the current definition of Pastureland found in the regulations <br />overlaps with the OSM definition of Grazingland. Therefore, to standardize the <br />usage of these overlapping terms, we have moved the Dryland Pasture - Reclamation <br />Page 3 <br />
