c) The listing of lessees was deleted from the Oil, Gas and Minerals section of 2.03.4(7), <br />but still remains in the Surface section. Please delete the lists of lessees from the <br />Surface section of 2.03.4(7). <br />Response — List of lessees from the surface section of 2.03.4(7) has been removed in <br />the revised text. <br />d) Tables at the bottom of Maps 2.03.4 -1 and 2.03.4 -2 identify several properties for <br />which WFC is the lessee. Several of the parcels listed appear to be those within the <br />New Horizon (NH2) permit area. Please remove lease information that does not pertain <br />to the NHN permit. <br />Lessee designation for the NH2 Mine parcels was not deleted as requested. On <br />Map 2.03.4 -1, please delete the Surface Lessee entries for parcels 1, 41 and 43. On <br />Map 2.03.4 -2, please delete the Minerals Lessee entries for parcels 41 and 42. <br />Response — The tables in Map 2.03.4 -1 and Map 2.03.4 -2 have been revised by deleting <br />surface and minerals lessee info for NH2 Mine. <br />2.04 — INFORMATION ON ENVIRONMENTAL RESOURCES <br />2.04.3 — Site Description and Land Use Information <br />5. DBMS: The response given by the applicant does not address Rule 2.04.3(1) which <br />requires a description of the existing premining environmental resources in the adjacent <br />areas. The Division agrees that the vegetation types and land uses in the areas adjacent to <br />the proposed mine site area are very similar, however, these adjacent areas have the <br />potential to be impacted by mining activities. Therefore, a description of the existing, <br />premining environmental resources of the adjacent area needs to be included in the permit. <br />Two areas in particular that need to be addressed are the wetlands west of CR 2600, <br />downstream of Meehan Draw and the irrigated pasture and wetland west of CR 2600 <br />adjacent to the Garvey property. <br />Response — Land Uses in the areas adjacent to and located within approximately one <br />half mile of the proposed NHN Mine Permit Area are shown on Map 2.04.3 -1, New <br />Horizon North Mine - Land Use Map. The tabular summary of the Land Use acreages <br />on this map shows that within the proposed NHN Mine Permit Area and in the <br />adjacent area, the Land Uses are fairly consistent. Irrigated Pastureland, Reclaimed <br />Grazingland, Big Sagebrush Grazingland, and Juniper - Sagebrush Grazingland occur <br />in similar percentages both within the proposed NHN Mine Permit Area and in the <br />adjacent area. A paragraph has been added at the end of Section 2.04.3 to include a <br />description of the premining environmental resources of the adjacent area. <br />6. DRMS: The response given by the applicant does not address Rule 2.04.3(4) which <br />requires a description of the existing land uses and land use classification under local law, if <br />any, in the adjacent areas.
