2.05.3(4) — Ponds, impoundments, other treatment facilities and diversions
2. DRMS: On page 6 of Section 2.05.3(4) of the May 26, 2011 response, Western Fuels
confirmed that the 2 " Park Lateral ditch is the same as the Colorado Cooperative Company
ditch. Western Fuels also states that they are in the process of getting approval from the
ditch company for relocation of the irrigation ditch. Please provide a copy of the agreement
for insertion into the permit application.
Response —A copy of the agreement with CC Ditch will be submitted once it is executed.
3. DRMS: In the May 26, 2011 response, WFC stated that an engineer's certification was
located in the permit application just before the SEDCAD designs. However, the Division
cannot find this engineer's certification. Please point out exactly where this certification is
located.
Response — Such certification is now included in Appendix 2.05.3(3) -1 before the
SEDCAD runs. Sedcad runs under Appendix 2.05.3(3) -1 were performed by WFC staff
and thus are included separately from the Sedcad runs performed by Arcadis that are
included in Appendix 2.05.3(4) -2.
4. DRMS: In the submittal dated May 26, 2011, a revised Arcadis report with the requested
cross sections was provided in the renamed Appendix 2.05.3(4) -1. However, the Division
has additional questions based on this recent submittal of the pond cross sections.
a) There does not appear to be a discussion in the permit application concerning the
construction methods that will be used for the three sediment ponds. Rule
2.05.3(4)(a)(ii)(B) requires construction specifications for the sediment ponds in order
to ensure that the factor of safety has been met. Please revise the permit text, perhaps in
Section 2.05.3(4) or Appendix 2.05.3(4) -1, to include a description of the construction
techniques that will be used for building the sediment ponds, pond embankments and
pond discharge structures.
Response — Such a discussion about pond construction techniques is included in
Appendix 2.05.3(4) -1.
b) Please add a discussion in the permit application as to whether any of the proposed
sediment ponds can be classified as having Class B or Class C dams, as defined in the
U.S. Department of Agriculture, Soil Conservation Service Technical Release No. 60
"Earth Dams and Reservoirs ", October, 1985. If any of the sediment ponds can qualify
as having a Class B or Class C dam, please revise the permit application to demonstrate
compliance with those Rules which apply to Class B or Class C dams.
Response — Such a discussion regarding the dam classification is included in Appendix
2.05.3(4) -1.
