DRMS: On page 6 of Section 2.05.3(4) of the May 26, 2011 response, Western Fuels <br />confirmed that the 2 " Park Lateral ditch is the same as the Colorado Cooperative Company <br />ditch. Western Fuels also states that they are in the process of getting approval from the <br />ditch company for relocation of the irrigation ditch. Please provide a copy of the agreement <br />for insertion into the permit application. <br />Response —A copy of the agreement with CC Ditch will be submitted once it is executed. <br />3. DRMS: In the May 26, 2011 response, WFC stated that an engineer's certification was <br />located in the permit application just before the SEDCAD designs. However, the Division <br />cannot find this engineer's certification. Please point out exactly where this certification is <br />located. <br />Response — Such certification is now included in Appendix 2.05.3(3) -1 before the <br />SEDCAD runs. Sedcad runs under Appendix 2.05.3(3) -1 were performed by WFC staff <br />and thus are included separately from the Sedcad runs performed by Arcadis that are <br />included in Appendix 2.05.3(4) -2. <br />4. DRMS: In the submittal dated May 26, 2011, a revised Arcadis report with the requested <br />cross sections was provided in the renamed Appendix 2.05.3(4) -1. However, the Division <br />has additional questions based on this recent submittal of the pond cross sections. <br />a) There does not appear to be a discussion in the permit application concerning the <br />construction methods that will be used for the three sediment ponds. Rule <br />2.05.3(4)(a)(ii)(B) requires construction specifications for the sediment ponds in order <br />to ensure that the factor of safety has been met. Please revise the permit text, perhaps in <br />Section 2.05.3(4) or Appendix 2.05.3(4) -1, to include a description of the construction <br />techniques that will be used for building the sediment ponds, pond embankments and <br />pond discharge structures. <br />Response — Such a discussion about pond construction techniques is included in <br />Appendix 2.05.3(4) -1. <br />b) Please add a discussion in the permit application as to whether any of the proposed <br />sediment ponds can be classified as having Class B or Class C dams, as defined in the <br />U.S. Department of Agriculture, Soil Conservation Service Technical Release No. 60 <br />"Earth Dams and Reservoirs ", October, 1985. If any of the sediment ponds can qualify <br />as having a Class B or Class C dam, please revise the permit application to demonstrate <br />compliance with those Rules which apply to Class B or Class C dams. <br />Response — Such a discussion regarding the dam classification is included in Appendix <br />2.05.3(4) -1. <br />There are three classes of dam: <br />Page 15 <br />
