Also during conversations with Mr. Ridgley he <br />has more plans for the property in the near future that include erecting a garage or <br />storage building on the southwest building site close to the volleyball area as well <br />as a sprinkler system in the same area. See attached letter from Mr. Ridgley. <br />These improvements are an enhancement of the property and for the landowners <br />enjoyment of his property. Whitewater believes that Mr. Ridgley and ourselves <br />can work together toward release of his property, but Whitewater does not want to <br />take on responsibility for these enhancements if they happen prior to our release. <br />All Stages: <br />In your inspection of Stage 2 A it was noted that `The success of the vegetation <br />near the water's edge was very good and appeared to be less successful farther <br />from the shore'. At our meeting September 1, 2011 Steve Shuey recommended <br />we take soil samples and address the seed mix accordingly. Whitewater worked <br />with the Colorado State Cooperative Extension and enclosed is a letter from them <br />with a seed recommendation they think will be successful for the soils on this site. <br />Whitewater requests to change our seed mix to their recommendation for future <br />planting. <br />Stage 3 B: <br />Whitewater has worked with the County of Mesa to install sewer service in the <br />area. The county requested from Whitewater a location on our property to install a <br />pump facility. As such Whitewater has entered into a long term lease with the <br />county to allow the county to erect the pump facility within the northwest corner <br />of Stage 3 as shown on Exhibit 3. This is in an area that will not be disturbed by <br />mining and Mesa County will be responsible for maintaining the area during and <br />after construction ends, including reseeding the area as appropriate for their end <br />use. <br />In conclusion, the changes noted in Stages 2A and 2B are landowner driven changes that <br />they have done to improve their use of their property. Being such Whitewater does not <br />take on the maintenance and upkeep of these improvements. Also they may make other <br />changes that are not within our control.
