The previous application listed the Section as 34. <br />The Division understands both sections are included in the mine location. Please <br />verify the intent in changing the Section number was that the majority of the <br />Amendment 4 activity will occur in Section 35, instead of Section 34. <br />b. Quarter Section & Quarter /Quarter Section: It appears the appropriate boxes to <br />check were reversed between the Quarter and Quarter /Quarter lines. The Division <br />believes the appropriate Quarter Section should be "NW" (not "SE" as checked) <br />and the Quarter /Quarter Section should be "SE" (not "NW" as checked). Please <br />confirm or clarify. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS — REGULAR 112 OPERATIONS <br />The following items must be addressed by the applicant in order to satisfy the requirements <br />of C.R.S. 34- 32.5 -101 et seq. and the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board: <br />6.4.1 EXHIBIT A - A - Legal Description <br />2. Please explain why the description including the drainage easement in the Brown <br />Subdivision was not removed and why the plat of the Brown Subdivision is still included <br />as within the permit boundary. <br />6.4.2 EXHIBIT B - Index Map <br />This section is adequate as submitted. <br />6.4.3 EXHIBIT C - Pre - mining and Mining Plan Map(s) of Affected Lands <br />3. Exhibit C: <br />a. Rule 6.2.1(2)(b) requires Maps and Exhibits be prepared and signed by a <br />registered land surveyor, professional engineer, or other qualified person. Please <br />include the appropriate signature and date on both Exhibit C, and "Exhibit C — <br />Mining Sections ". <br />b. The 150 -ft drainage easement in the Brown Subdivision is included as part of the <br />permit boundary on Exhibit C. Please remove the area from Exhibit C. <br />c. The "straight line" permit boundary on the south side of the Phase 7 area follows <br />the property boundary instead of staying north of the Arkansas River and <br />following the irregular shape of the proposed Phase 7 excavation. Please correct <br />the permit boundary as appropriate. <br />
