C.R.S. 34 -32- 116(3) and (4), 1989 Supp. and Permit No. M- 1982 -090 require you to submit to the Division of Reclamation,
Mining and Safety (the "Division ") $633.00 in annual fees and an annual report on or before December 7 of each year. As
of the date of this letter the Division has not received your annual fees and report for 2009 or 2010. Therefore, the Division
believes you are in violation of the above cited statute and the provisions of Permit No. M -1982 -090.
NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO ANY OPERATOR WHO IS
CURRENTLY FOUND TO BE IN VIOLATION IN THIS STATE (C.R.S. 34 -32 -120) UNTIL THE VIOLATION IS
ABATED. The annual report and fee requirement is not met until we have received the following components: fee, report,
and associated map for 2009 and 2010. If no new disturbances or reclamation have occurred during each report year and no
new changes to the previous year's map are necessary, then no new map is required, provided that the Operator shall state
this in each annual report.
If you fail to submit the 2009 and 2010 Annual Fee, 2009 and 2010 Annual Report, and the civil penalties assessed by
December 23, 2011, this matter will be heard at a Formal Public Hearing before the Mined Land Reclamation Board at the
January 11 -12, 2011 Board Meeting for consideration of a possible violation and Board affirmation that the financial
warranty noted below is subject to forfeiture;

If you submit all past due annual fees, reports, and the Civil Penalties by December 22, 2011, this matter will be withdrawn
from further Board consideration.
The Board Meeting will be held on January 11 -12, 2012, in Room 318 of 1313 Sherman Street, Denver, Colorado,
beginning at 9:00 a.m. or as soon thereafter as the matter can be considered, and you will have the opportunity to be
represented and heard.
