Page 2 <br />Durham Pit, DRMS M- 1978 -056 November 16, 2011 <br />Replacement <br />VCI is able to cover the additional Feit Well depletions by using existing sources as already <br />approved in the previous SWSP. These source includes Cache la Poudre credits from five shares of <br />Greeley Irrigation Company (GIC) as well as St. Vrain Creek sources controlled by VCI which includes <br />the Rural, Last Chance, Godding, and Hayseed Ditches. VCI's storage operations study was amended <br />to include the additional Feit Well depletions. Results of this study are shown in Tables 3A and 3B and <br />show that VCI is still able to meet their demands after increasing the Durham Pit requirements due to <br />the Feit Well. <br />Conditions of Approval <br />I hereby approve the proposed amended substitute water supply plan in accordance with <br />C.R.S. § 37 -90- 137(11), subject to the following conditions: <br />1. All conditions listed in the SWSP approved for the Durham Pit on February 14, 2011, as amended <br />on August 3, 2011 remain in effect except as modified herein. A copy of the original approval is <br />attached for your reference. This amendment does not alter the approval period of this plan, which is <br />January1,1011ithrough December 31, 2012 unless otherwise revoked or modified. If this plan will <br />not be made absolute by a water court action by the plan's expiration date, a renewal request must be <br />submitted to this office with the statutory fee (currently $257) no later than November 15, 2012. <br />2. Permit 57742 -F is specific to the use of ground water for drinking and sanitary purposes at the Feit <br />Pit (M- 1977 -552), at a rate not to exceed 15 GPM, and an annual amount not to exceed 0.1 acre - <br />foot. The proposed use has changed to concrete batching and drinking and sanitary purposes at <br />the Durham Pit (M- 1978 -056), with a projected annual amount of 3.23 acre -feet. Thus a new well <br />permit must be obtained. The provisions of Colorado Revised Statute 37 -90- 137(2) prohibits the <br />issuance of a permit for a well to be located within 600 feet of any existing well, unless the State <br />Engineer finds that circumstances so warrant after a hearing held in accordance with the procedural <br />rules in 2CCR402 -5. This hearing may be waived if you are able to obtain statements from the <br />owners of all wells within 600 feet, verifying that they have no objection to your use of the proposed <br />well. Should a new well permit be denied for reasons of 600 foot spacing, or any other legitimate <br />reason, approval of this SWSP amendment may be cancelled. <br />3. Approval of this amended SWSP is for the purposes as stated herein. This office must first approve <br />any additional uses for the water. Any future additional historical consumptive use credit given (e.g., <br />agricultural water transfer) for this site must consider all previous credits given. <br />4. Adequate accounting of depletions and replacements must be provided to the division engineer in <br />Greeley (Div1Accountinqstate.co.us) and the water commissioners (George Varra at <br />George.VarraCa�state.co.us) and (Shera Sumerford at Shera.Sumerford(a�state.co.us) on a monthly <br />basis. The accounting form provided with your application is subject to modification and approval <br />by the division engineer.
