Director /State Engineer Dear Ms. Signs: Division of Reclamation, Mining & Safety This letter is in response to your letter dated September 26, 2011, requesting an amendment to the approval of the Varra Companies Inc, ( "VCI ") Durham Pit Substitute Water Supply Plan ( "SWSP ") dated February 14, 2011, as amended on August 3, 2011. The purpose of this 2" amendment is to include the use of a well with permit No. 57724 -F ( "Felt Well ") (WDID 0304999) which was purchased by VCI and has subsequently been dropped by Star Ready Mix's Feit Pit SWSP (WDID 0302580). All other consumptive uses of the amended SWSP approved for the Durham and Dakolios Pit will remain the same as in the August 3, 2011 approval. Plan Operation VCI purchased a concrete batch plant located on the Feit Gravel Pit from Star Ready Mix. This purchase included the use of the Feit Well. VCI has assumed responsibility for augmenting all future depletions associated with this concrete batch plant, including all future withdrawals from this well. Star Ready Mix is responsible for all lagged depletions from previous pumping of the well. Depletions The Feit Well is expected to withdrawal 3.23 acre -feet during water year 2012 (WY 2012). See Table 1 for a monthly breakdown of the well's projected withdrawals and depletions. The monthly depletions from this well were lagged to the river using the AWAS program developed by the IDS Group at Colorado State University. The parameters used in the model were an estimated distance from the well to the Cache la Poudre River (X) of 1,000 feet, an estimated distance from the well to the no flow aquifer boundary (W, measured perpendicular to the point of impact) of 4,300 feet, an aquifer transmissivity (T) of 120,000 gpd /ft, and a specific yield (S) of 0.25. The depletion & replacement requirement for the Durham Pit has been amended to include the depletions associated with the Feit Well (See Table 2 - attached). The net annual depletion for the Durham Pit is 52.78 acre -feet. The net annual depletions for the Dakolios Pit are not changed with this amendment and are 7.69 acre -feet.
