access to adjacent Fort Carson (Gate 19A). Portions of this road are paved. A <br />new access location is proposed for the permit amendment area. <br />The following comments /conditions regarding the permit amendment are <br />offered by our Public Services Department: <br />1. Per current County records, Charter Oak Ranch Road is indicated as a <br />El Paso County owned and maintained right of way to the southerly <br />terminus. It lies adjacent to a proposed mining expansion of this pit. It is <br />not a private road. It does serve at least one residence. <br />2, No work will be permitted within County road right-of-way without the <br />required permitting. This may include but not be limited to, construction <br />permit, ESQCP, work in the row permit, traffic control plan for <br />construction, and special transport permitting the event of <br />overweight/oversize Toads. <br />3. No slope grading or any other work will be performed within the 60' <br />prescriptive road row without improvement plans (plan and profile) <br />prepared by a Colorado licensed civil engineer. These plans shall be <br />reviewed by the Development Services Department engineering staff for <br />the approval by the County Engineer. <br />4. Plan and profile for roadway improvement plans shall adhere to all ECM <br />criteria for design of public roads. <br />5. Slope grading outside the 60' prescriptive right of way, adjacent to the <br />roadway (on private property) shall not encroach more than grading a <br />1:1 cut slope adjacent to the 60' right of way. <br />6. Any construction which is approved for the road shall be required to <br />provide 24 hour local access to any properties which have their access <br />to this road. <br />Fort Carson has recently opened a new access gate off of Charter Oak Ranch <br />Road. This access has substantially increased the traffic utilizing the paved <br />portion of the road. In the event that improvements to the road are proposed in <br />the future, Schmidt Construction, Inc. will be expected to participate in those <br />improvements at a level commensurate to the impact attributable to the mining <br />operation. This will likely be incorporated as a condition attached to their new <br />access permit or other permits from the County. To the extent that private <br />properties are served by this public road, the integrity and safety of Charter Oak <br />Ranch Road must be assured through the final mining plans. <br />Please note that El Paso County enjoys a very cooperative relationship with <br />Fort Carson, and has coordinated with Fort Carson in another border location to <br />acquire buffer properties. An opportunity may exist to implement a similar <br />program in this location, which could potentially eliminate the need to keep a <br />public road in this location. This would appear to be reflected as Option 2 <br />(Exhibit C -5). El Paso County would appreciate this option being kept open to <br />allow subsequent coordination with all parties involved. <br />
