OBSERVATIONS <br />PERMIT #: M -1976 -032 <br />INSPECTOR'S INITIALS: RCO <br />INSPECTION DATE: October 13, 2011 <br />This was a routine inspection performed by the Division as part of its monitoring of Construction Materials <br />112c permits. The operator named on page one was present throughout the inspection. There is no <br />excavation of native materials carried out at this site. All materials that are stockpiled or processed here are <br />imported from other permitted pits or from the operator's offsite construction jobs. Imported materials are <br />all inert and include: sand and gravel, waste concrete and asphalt, and topsoil. Onsite processing includes <br />crushing and concrete batching. Though the site is busy, it is well maintained and clean. <br />Acid And Toxic Materials: <br />All hydrocarbons are stored properly and there is no evidence of spillage or leakage. All fluids are secure and <br />have adequate secondary containment. <br />Financial Warranty: <br />The bond is $50,000, and has been considered to be adequate. It is time for the Division to recalculate the <br />bond. New figures will be forwarded to the operator under separate cover for review. If an increase is <br />indicated, the operator must provide the increased amount within 60 days. <br />Hydrologic Balance: <br />All stormwater at the site is controlled. No runoff reaches the San Miguel River or the onsite pond at the west <br />end of the site. The sediment pond is adjacent to the pond, and stormwater runoff that reaches the sediment <br />pond is allowed to percolate into the ground. <br />General Compliance With Mine Plan: <br />The site contains numerous structures and areas where several activities are carried out. These are approved <br />under the permit and consistent with industrial land use approved by the county. <br />Reclamation Success: <br />The current reclamation plan is consistent with the approved post- mining land use of "rangeland." There is a <br />small area along the San Miguel River, at the eastern end of the site, which was affected by permitted mining <br />activities in the past. This land has been reclaimed and the operator will not re- disturb it, but is still in the <br />permit. An "acreage reduction" request to remove reclaimed areas from the permitted area was discussed. <br />Please refer to Construction Materials Rules 4.14 and 4.17 for discussion of this issue. <br />Also there are some distinct areas within this permitted area that are used solely for the operator's <br />construction business and not used for mining - related activity. Since these areas are not reclaimed as <br />rangeland, they would not currently be eligible for removal from the permitted area, even if they are not <br />planned for future mining - related disturbance. However, the approved post- mining land use may be revised <br />for parts of the permit, to agree with locally- approved land use, which then may allow removal of them from <br />the permitted area and /or reclamation bonding. <br />Revegetation: <br />There are several areas within the permit that are reclaimed: slopes along the county road are stable and <br />vegetated, fill areas at the west end of the permit, and the land along the river at the east end (mentioned <br />above). <br />Page 2 of 5 <br />
